However, it probably doesn't matter which side loses, they will appeal to the Supreme Court.

Trump can win by losing the case. ??

More than anything at this time, he wants to delay. If it is ruled in the DOJ's favor, then Trump will delay and do his propaganda thing, trying to build a narrative, and it will take more time for it to reach the Supreme Court. So, in that regard, he would think he has won.
