I get the delay. Dearie just asked them to produce a document that doesn't exist.
And not only that, classification is irrelevant due to the DOJ investigation into crimes that don't involve the classification of the documents.
Today's hearing may change things a bit... and that's less than 4 hours away. I read an amicus brief yesterday. The whole thing should be a slam-dunk. Any document created by the executive branch for use by a President in the course of Presidential duties is, by definition of the Presidential Records Act, a Presidential Record. It is therefore property of the American people to be held in the custody of the National Archives.
Then again, it's the 11th Circuit filled w/ TFG appointees. We can't expect TFG's partisan hacks to recognize the rule of law. (Though his judges did manage to recognize the election fraud nonsense for what it was.)

(4,616 posts)Is cutting through the BS quick. The classification is irrelevant to the possession of presidential records. The DOJ wants the classifieds so they can damage access and safeguard them. Trump wants to keep the DOJ from having them. Dearie just asked Trump to put up or shut up. I'm betting he'll give the DOJ back the classifieds and work from there. After all, it was Trump and his teams who asked for that and they did provide Dearie's name as their choice.

The department is now planning to appeal the decision, and top officials were meeting to discuss the timing of their filing, according to a senior law enforcement official.

While Judge Cannons order was a victory for Mr. Trump and his legal team, she also made two significant concessions to the government.
She said, for instance, that Judge Dearie should first look at the classified documents and thereafter consider prompt adjustments to the courts orders as necessary. That raised the possibility that Judge Dearie might quickly clear the items and the F.B.I. would then regain unrestricted use of them in its criminal inquiry. In her order, Judge Cannon said the special master should try to finish his review by Nov. 30.

So Dearie is quite reasonably asking the Trump lawyers which ones they think are classified. Those lawyers now realise that trying to claim that classified documents are personal records of a person no longer in government means they they have to admit to the classified markings.

(4,616 posts)They made an error thinking Judge Dearie would roll over for them. I'm going to make a prediction. The SM wants to know "Hey, are these actually classified docs?" What exactly are you asking me to do here and what is the remedy you are seeking? Trump refuses to answer. Meanwhile the DOJ says 'YES, these are absolutely classified and should be excluded from what you are looking through Mr. SM." If Dearie gets a "we're not saying, we not answering and the DOJ says yes, they are classified and we need them in the interest of Natl Security, then I predict Dearie will turn the classified docs back over to the DOJ. I could be wrong, but it sure seems like a good bet to me. Trump and his attorney are not ready for prime time. This is what you get when you have a has been reality host and a bunch of strip mall lawyers.
