The Justice Department asked an appeals court last week to do an end run around the Florida federal judge that keeps contorting the law in favor of former President Trump.
The DOJs move has infuriated the former President, who complained to the same court on Monday that speeding up the case at all would damage him with more bluster that he faces an investigation from his political opponent.
Federal prosecutors on Friday asked the 11th Circuit Court of Appeals to invalidate an order from U.S. District Judge Aileen Cannon for the Southern District of Florida, a Trump appointee, installing a special master in the case.
That independent arbiter U.S. District Judge Raymond Dearie for the Eastern District of New York was hand-picked by Trump after Cannon took the unheard of step of halting the DOJs pre-indictment investigation into records that Trump stashed at Mar-a-Lago after his presidency ended. The 11th Circuit stayed that order as it applied to classified records.

I guess he'll be like a zombie, though. Keep on moving, years after the brain has stopped effectively functioning.
Still, he's gotta be pushing 300 lbs in that picture. Keep eating those Big Macs and KFC, Two Scoops! And snorting that Adderall, or whatever it is you do that gets you out of bed in the morning!

(42,753 posts)Answer: DOJ is caught between a rock and a hard place. If the review is stayed and then the court rules against DOJ (which can't be ruled out), then the review is delayed by several months. If they don't ask for a stay, even if they get the expedited timeline, the review will be well underway by the time the court would rule, which makes it harder for the court to justify intervening on an expedited basis.
Trump's filing shows, for a rare moment, that an experienced attorney is involved. The original schedule set by the 11th Circuit called for DOJ's brief to be filed by October 19, Trump's opposition by November 18, and DOJ's reply by December 9 (although DOJ could file earlier than that if it wanted). DOJ's expedited schedule would move up the deadline for its brief to October 14, with Trump being given 20 days (until November 4 ) to oppose and DOJ would have 7 days (until Nov. 11) to reply. Trump's pleading accepts the expedited schedule that DOJ proposed, with one modification -- he wants the same 30 days to reply to the appeal that he would have under the 11th Circuit's original schedule (and the court rules) not the 20 days DOJ has proposed. That would put the deadline for Trump's opposition at November 14 and DOJ's reply at Nov. 21. Oral argument would follow the filing of the DOJ reply -- DOJ wants it held as soon as possible after the filing of its brief, while Trump wants it delayed until after the new year.
It will be interesting to see how the court reacts to this. They might well give Trump his extra ten days, but still forge ahead with an expedited oral argument. But any way you slice it, the case isn't likely to be decided until mid December at earliest and by then, as mentioned, the document review will be all but over, given that Cannon's current schedule calls for it to be wrapped up by December 16.

I got lost trying to understand the details about what Trump wants vs. what the DOJ wants and decided 1. I don't have the patience to sort out all the minutiae, and 2. In any dispute between TFG and the DOJ, I already know it's the DOJ who's going to be right and not the bloviating liar king.
