Under oath?
If he refused, it would be an automatic indictment. He would know before hand what the stakes are?
He needs to answer some questions.
It's time to get serious.
If the DOJ starts now, they will be ready to make a decision, of whether or not to charge, after the election.
He should be subpoenaed now.
Just my opinion.

Force him to take the 5th in front of a grand jury, which is what he will do.

The DOJ prosecutors would rather negotiate with him then prosecute him.
They are timid and fearful.
