Former Democratic presidential nominee Hillary Clinton is asking a federal court to order former President Trump to pay her legal fees over a suit he filed alleging she and others engaged in a conspiracy to undermine his 2016 campaign with accusations of Russian collusion.
In a motion filed on Monday, Clintons attorneys cast Trumps suit which was dismissed by a federal trial court in September, a move the former president has appealed as a political stunt and argued it met the threshold for the court to impose sanctions.
A reasonable attorney would never have filed this suit, let alone continued to prosecute it after multiple Defendants motions to dismiss highlighted its fundamental and incurable defects, Clintons attorneys wrote.

Clintons attorneys for months have cast Trumps suit as being politically motivated, and a judge appointed by former President Bill Clinton in September tossed the suit, describing it as political manifesto. Trump has since appealed to the 11th Circuit.
Under federal law, a judge can require attorneys who unreasonably and vexatiously multiply court proceedings to pay excess costs, expenses and attorneys fees reasonably incurred because of their actions.

Hillary Clinton asked a federal judge to sanction former President Donald Trump and his lawyers for filing an allegedly frivolous lawsuit accusing them of conspiring to undermine his term in office.
Trump and his attorneys should be ordered to pay $1.06 million in legal fees and costs that were racked up by Clinton, her 2016 presidential campaign and several other Democratic-linked defendants for filing the suit as a political stunt, according to a filing Monday in federal court in Florida.

Former President Donald Trump is appealing a federal judges decision last month to dismiss his sprawling lawsuit against Hillary Clinton, the Democratic National Committee, several ex-FBI officials and more than two dozen other people and entities that he claims conspired to undermine his 2016 campaign by trying to vilify him with fabricated information tying him to Russia.
Trumps attorneys filed a notice Tuesday indicating they are appealing to the 11th Circuit Court of Appeals.
Last month, US District Judge Donald Middlebrooks dismissed Trumps lawsuit, saying, most of Plaintiffs claims are not only unsupported by any legal authority but plainly foreclosed by binding precedent.

What (Trumps lawsuit) lacks in substance and legal support it seeks to substitute with length, hyperbole, and the settling of scores and grievances, Middlebrooks, an appointee of former President Bill Clinton, wrote.
Trump filed his sprawling lawsuit in March, naming a wide cast of characters that Trump has accused for years of orchestrating a deep state conspiracy against him including former FBI Director James Comey and other FBI officials, the retired British spy Christopher Steele and his associates, and a handful of Clinton campaign advisers.

MSNBC just had a fantastic, long segment on all the messaging/lies coming from the internet, FOX and GOP politicians etc. How dangerous the lies are and how quickly they spread. They had some good guests that were visibly upset about the dangerous rhetoric and the dangers of more violence.
Perhaps you could find it on MSN's site.

(11,092 posts)The supervising member of SCOTUS should only get involved if there is a further appeal to SCOTUS or a petition for emergency stay pending appeal to SCOTUS.
The 11th Circuit is a conservative court. If TFG loses on appeal - as he clearly should - SCOTUS should never be involved beyond denying a cert. petition.

(35,950 posts)He won the last 11th Circuit appeal and Thomas ruled on it right from the shadow docket. It's even doubtful his ruling will be reviewed by the whole court. And maybe these appeals are about different things, I dunno. Ordinarily I'm for due process but with tfg I'm just pessimistic about this prolonged due process bs.
Do you seriously think tfg will lose on appeal?

(11,092 posts)You can lookup any case in the federal system using PACER but you have to have an account and there is a per page fee.
Several states have similar systems for the state courts. They vary from state-to-state with how complete and user-friendly. Surprisingly, Arkansas has one of the better ones.

(144,945 posts)This is the long lawsuit filed by two shopping center lawyers representing TFG against Hillary Clinton and large number of other people such as Comey, Perter Struck and others. No top tier law firm would touch this lawsuit. One of of the defenses to the statute of limitations defense was that TFG was too busy being POTUS to file this lawsuit

In throwing out Trump's lawsuit Thursday night, Judge Donald Middlebrooks of the U.S. District Court for the Southern District of Florida said the lawsuit was not seeking "redress for any legal harm" and that the court was "not the appropriate forum" for the former president's complaints.
"He is seeking to flaunt a two-hundred-page political manifesto outlining his grievances against those that have opposed him," Middlebrooks said in his ruling.
Trump in March had sued Clinton, who was the 2016 Democratic presidential nominee, and several other Democrats alleging "racketeering," a "conspiracy to commit injurious falsehood" and other claims in a 108-page lawsuit that echoed the long list of grievances he repeatedly aired during his four years in the White House after beating Clinton.
He had sought compensatory and punitive damages, saying he had incurred more than $24 million in "defense costs, legal fees, and related expenses."
In his ruling, Middlebrooks said Trump had waited too long to file his complaint by exceeding the legal statute of limitations for his claims and that he failed to make his case that he was harmed by any falsehoods, noting that many of the statements made by the defendants were "plainly protected by the First Amendment" of the U.S. Constitution.
The opinion is 65 pages but is a fun read. The judge had fun telling TFG's shopping center lawyes that they re idiots
