I don't think the DOJ can avoid calling a grand jury, and indictment of trump. There are just too many

witnesses who were part of that administration that have testified before the January 6th committee, and recorded conversations of illegal activities which he participated in for multiple illegal activities.

That being said, it seems that won't happen until after the Georgia runoffs
