The so-called "Alliance Defending Freedom" brought the suit and largely argued hypotheticals to try to overturn anti-discrimination laws in Colorado. that apply to these lifetime-appointed people. Unlike any other federal judges, they are not even required to recuse themselves in the case of a conflict of interest.
This works only as long as everyone makes it work. Like the norms and guardrails that Trump kept smashing the talking heads bleated and wrung their hands, and nothing was done that could make him stop.
I finally figured out norms are not laws. What they are is the equivalent of a gentlemens agreement from a bygone era. People who have solid ethics and/or an acute sense of social shame will not break norms and with Trump we were confronted for the first time with a president who had no shame whatsoever. An oath of office worked well in a society where most people took the Almighty seriously enough that they were not only wary of social shaming and prison, but really believed in repercussions in an afterlife. The very meaning of oaths has been slipping for quite awhile.
The Supreme Court has been corrupted beyond belief, imo. Thanks to a 40+ year plan, we now have a 6-3 majority of religious fanatics in charge. As has been proven throughout human history, power corrupts, and absolute power corrupts absolutely and when you truly believe the Almighty (see above) endorses your behavior rather than restrains it, very bad things happen. Alito is so confident in his place in the universe of a punitive and hateful god that he has no difficulty citing a medieval cleric and a 16th century witch-burner in an opinion affecting the life of every woman and girl in a 21st century nation founded on secular 18th century Enlightenment principles.
Now he has publicly smeared the good name of a fellow Justice who is a single woman and a Jew.
You are right: this is sexual harassment. Its also revelatory of the sheer contempt he holds for everybody who isnt male and his brand of Christian.
But who is going to stop him now? He has a 6-3 majority, a lifetime appointment, an undemocratic mindset, and the endorsement (in his mind) of God Almighty.
brush
(53,759 posts)He thought he was being sly in doing this to a fellow justice but he's just destroyed any collegiality at SCOTUS.

Employment Opportunity Commission - US EEOC
Sexual Harassment It is unlawful to harass a person (an applicant or employee) because of that person's sex. Harassment can include "sexual harassment" or unwelcome sexual advances, requests for sexual favors, and other verbal or physical harassment of a sexual nature.

Sexual Harassment in the Workplace - National Conference of State ...
Aug 12, 2021In the late 1980's, the Supreme Court interpreted Title VII of the Civil Rights Act of 1964 to include discrimination based on "sex" as sexual harassment in the workplace. The law recognizing sexual harassment as a form of sex discrimination applies to private employers with 15 or more employees, as well as government and labor organizations.

Workplace Sexual Harassment: The Basics - National Women's Law Center
Generally, under federal law, employers are responsible for sexual harassment that is severe behavior, like sexual assault, even if it only happens once, or it can be less severe behavior that keeps happening again and again. Whether your employer is responsible for the sexual harassment also may depend on who did the harassment.

But there is no situation in which an unwanted comment at work will land someone in jail, which is what you implied. That is civil. That is not criminal. This is precisely why you cannot cite a single case of someone going to jail for making a comment at work.
Its total misinformation.
