Trump is giving up on the special master case. Not appealing the 11th circuit decision.

For all of those who were convinced that the 11th circuit's order would be delayed by Trump appealing and getting the Supreme Court to put the decision on hold -- you can stop fretting.

As of today, the 11th Circuit's mandate will issue and DOJ will be free to use everything it found at Mar-a-Lago, except for those documents it concedes are subject to attorney-client privilege.

I asked this in another thread, but received no answer.

Can he decide in a week that he wants to appeal, and that would put a halt to whatever examination had begun? Or is he now barred from ever appealing the ruling?

But once the mandate issues and DOJ is able to access the documents, it will be all but impossible to unring that bell. It already was highly unlikely that SCOTUS would agree to hear a challenge to the 11th Circuit's decision (having opted not to get involved when Trump challenged the earlier 11th Circuit decision that pertained specifically to the classified documents but relied on the same reasoning as the more recent decision ). Moreover, his failure not to make a timely attempt to stop the mandate from issuing makes it all but certain that SCOTUS would deny a petition for cert.

Interestingly, the latest breaking news is that DOJ has gone to court in DC for a contempt order against Trump's team for jerking them around with respect to the Mar-a-Lago documents; apparently, none of Trump's lawyers will step up and take responsibility as the custodian of Trump's documents and attest that there are no more classified documents out there.

losing their license over frivolous lawsuits - defense based on arguments with zero evidence, outright lies, or playing stupid games stretching the laws in the book

for no pay? Or even paid up front?

Remember, SCOTUS refused to step in and stop the 11th Circuit's previous decision pertaining to the classified documents from taking effect. The 11th Circuit's reasoning in that case was the same as in the case just decided with respect to the rest of the documents, so there was really no point.

I can't think of a situation where he has gone to SCOTUS to challenge a decision where he previously sought, and failed, to get the Court to hear essentially the same decision from the same appeals court based on the same facts.

Coincidence or no? This week the Trump org was found guilty on all charges in NY state court. Trump org now has a court appointed monitor to monitor all financial transactions of the company. The senate was lost, the red wave didn't happen, he's being publicly dissed and blamed (Even FOX is piling on) and fundraising is drying up. My guess, he's out of money and out of rubes to keep paying for his what 507 current bogus court cases.
