But the GOP will have a very difficult time convincing anyone of criminal intent. No one seemed to know the documents were missing (yes, that's a problem for the National Archives), the President didn't seem to know he was in possession of the documents, and as soon as they were found they were returned.
In stark contrast to taking the documents, being asked for the documents, trying to "negotiate" to keep the documents, claiming the documents were personal property, claiming to have declassified documents with his mind, and then claiming that he didn't have any more documents (and NARA was full aware that there were--AND STILL ARE--records that are not accounted for).
(On edit: Actually, I'm not sure if the lawyers work for President Biden personally, or work for the White House.)

The "real" questions, are much more mundane. first, what were they and what would the impact be if lost? If these were mostly situation briefings on low level topics, or background materials on something he was teaching, it could be pretty mundane.
There may have been some secret docs, but no reported TS or TS/sci which would be much more sensitive.
Second would be what was the chain of custody. Presumably biden didn't have personal control over the docs, and may not have been in that office in years.
If they were just mis-filed and left behind, it's a nothing burger. Some aide will be responsible.
Now if they were extremely sensitive documents, and were in his bedroom desk with his passport on top of them, it's much more serious.....
Even in gov't offices, they will frequently find classified docs misfiled. In computer systems, it happens as well.
The important thing is the process used once the discovery is made; usually it's no big deal unless it was intentional or the info was very sensitive.

(14,752 posts)I'm as critical of the doj's timidity as anyone, but I doubt garland had this leaked as a way out.
There are still maga trolls at doj, and other agencies that might be involved, so leaks can happen. We've seen leaks before wrt to gaetz investigations as well as others.
But it wasn't garland, or smith. I doubt smith will even blink an eye at the details of this find. He is focussed on tfg's offenses. It's like stopping to look at a liquor store holdup when you are prosecuting major bank robberies. They aren't connected.
