I read here, about "numerous" TV prosecutors claiming that the Trump prosecution is nearing the end, not so fast, so says Andrew Weissmann. I will name names. Weissmann said that Jack Smith wants to lock down Mike Pence's testimony in stone via the grand jury.
Locking down Pence lets Smith know how he will testify at a trial.
Also, the discussion about executive privilege was unanimous that Pence/Trump claiming it would lose in court and it most likely will be resolved in just a matter of months.

IMO Pence's testimony could have been locked down a year and a half ago.

(39,120 posts)up the ladder to the SCOTUS: Pence's and Trump's. Both will claim Executive Privilege.
Such cases could well take us past the 2024 election before being ruled on, and it won't necessarily be in the favor of testimony.

They didnt appeal the lower court ruling, they just used it to support their compliance with their subpoenas.

Downplayed the indication that the Smith/Garland probe is circling around Trump.
It's obvious that Weissman, who just months ago was insisting there wasn't an investigation into the Trump WH at all by Garland, is now forced to backtrack and cover with this ridiculous take that subpoenaing Pence isn't on the road to closing in on Trump.
Nothing supports his absurd claims that DOJ could have had Pence's testimony a year ago, or that they needed to make that move before now.
It's nauseating listening to him second guess the DOJ, the main effect of his whinging to downplay the investigation and make it appear that nothing is happening, or that maybe he could handle the investigation better. What a inflated sense he has, of himself.
Weissman should be reminded that the previous Trump probe he was involved in had 10 mos. of investigation and then the appointment of Mueller, and that puts us at about April, the same time Manafort and Gates were indicted (prosecuted by Weissmann) for this SC to bring charges in the SAME time period.

(94,667 posts)Because most of the other facts can be established by other witnesses, such as the Pence staffers who testified before the January 6th Committee, I expect Pence is one of the *last* witnesses Smith would call if he was building a case around the electoral vote certification.

For that reason, this suggests that Smiths January 6th investigation is far along. It also suggests that he is pursuing that aspect of his investigation aggressivelyhe isnt focusing largely on the Mar-a-Lago documents matter and putting January 6th on the back burner.

Its more likely Smith is building a case against Trump. That doesnt mean Trump will be charged, but todays news should greatly concern Trumps team.
We now know Smith is pushing hard to investigate January 6th, and it looks like hes developing a case against Trump.

Pence has always been the essential witness when it comes to establishing whether or not Trump's involvement in the pressure campaign for the VP to interfere with the election result was criminal. Smith has to get his testimony before he can make a prosecutive decision.

But, pence does feel like a late in the game witness. Someone you want to talk to you after you have all of the other testimony, and when you're just about ready to make a decision.

If Smith and DOJ then have testimony and documents from Mark Meadows and Mike Pence -- two of the people who were the closest to the center of the events from November 3, 2020 to January 6, 2021 -- then the stage is set for subpoenaning Trump, or just indicting him.

What an absurd thing to sling around about the SC.
