When I was in school, a lot of things could get you expelled. Excessive violence, drugs, sexual assault.
My district requires a judge to issue permission to expel a student--to certify that the student is so *much* a risk that his/her presence violates other students' rights. The admin or district can't make that decision.
One girl at a campus was obliged to attend class in the same room with her rapist. Oops--it happened off campus. But to move *him* would be violative, to move *her* would make her one graduation path impossible without another year of school. The judge said that since he'd raped her *off* campus and not *on* campus, there was no suggestion that she was threatened. Request denied.
Ah, SCOTUS in the '70s and '80s.
