If the Massachusetts legislature is Democratic than they can could

repeal the bill they passed in 2009 (to allow for a temporary successor to the Senate to be named by governor) and put back the one that allowed for a governor to appoint a successor (that was pulled in 2004, under Mitt, when Kerry ran for President).
