"SNIP.......

“Justice Department and FBI investigators have amassed fresh evidence pointing to possible obstruction by former president Donald Trump in the investigation into top-secret documents found at his Mar-a-Lago home,” the Washington Post reports.

“The additional evidence comes as investigators have used emails and text messages from a former Trump aide to help understand key moments last year.”

“The new details highlight the degree to which special counsel Jack Smith’s investigation into the potential mishandling of hundreds of classified national security papers at Trump’s Florida home and private club has come to focus on the obstruction elements of the case — whether the former president took or directed actions to impede government efforts to collect all the sensitive records.”

But I’ve been told that it’s a slam dunk case that should’ve been charged 26 months ago, and no new evidence was needed.

Somebody’s been fibbing…

...the vast majority of GOP politicians that were involved and very much broke laws trying to break our nation will get by without even being investigated?

I would love for Pres. Biden's second term to be a cleanup of Washington D.C. (and any applicable state level lawmakers, too) by the DoJ. Doing so would restore the world's faith and confidence in America.

is that it says Jack Smith is focusing on obstruction of justice. It always seems to be the way for the rich and powerful. Instead of getting charged with the actual bad thing they did that actually carries severe penalties they wind up getting charged with crimes associated with their crimes which tend to carry far less penalties and they wind up doing less time than Joe Blow gets for Possession of two ounces of weed in Alabama.

Maybe trying to provide a silver lining here, but...
Pursuing evidence of obstruction might be a handy tool in a prosecution of the "actual bad thing" because it establishes the perpetrator knew they had broken the law. And, it's one more felony.
Just speculating.

No doubt they have the evidence Trump mishandled docs. It’s march harder to prove he knew he was doing so. However, once he was called out, obstruction becomes much easier to prove when he starts taking action to avoid compliance or conceal his non-compliance.

11. I am guessing that the key issue is proving intent
Sun Apr 2, 2023, 05:34 PM

There may be little or no evidence of his intent to take the documents for illegal purposes and the defendant can argue that a) it is a common occurrence b) prosecution is using selective prosecution by not prosecuting Biden and Pence.

The evidence for intent on obstruction of justice will be based on testimony and written communication from employees and attorneys.

Penalty for federal obstruction of justice carries a potential 5 year prison sentence and in some cases can be elevated to 20 years.

Prosecutors are only interested in one thing: Finding the path to prosecution that yields a 98% conviction probability.

I hope against hope that I am wrong. I want so much for the path that led to to nothing happening to Nixon or Agnew will not be followed and that they will follow it all the way up to the money behind the coup.

Starting with NY, then other indictment’s to follow so much that he loses his mind and has a breakdown of some sort that turns off his cultists.

And I hope that judge in NY invokes a gag order on him. I’d like to turn on the evening news and Not It having his name mentioned at all.

until DoJ actually gets the courage to indict and arrest him.

We've been talking about his crimes out in the open for years now, and DoJ has done absolutely nothing. They should have arrested him while he was in office. Their stupid memo of "can't indict a sitting President" is the dumbest thing I've ever seen. It's neither Constitutional, or in line with the rule of law.
