Resign-to-run laws are intended to ensure that elected officials dont neglect their duties while pursuing other offices, misuse public resources for their campaigns, or unfairly leverage their position for an advantage over competitors. Opponents argue that they make elections less competitive.
Lawmakers in other states have also proven that they are open to debate on such laws under the right circumstances.
Always a way around the rules for some of those among us 🙄... but for now, according to state laws, Abbott, DeSantis, and Kemp are required to resign if they decide to run.

(39,167 posts)Article 16, Section 65(b) of the Constitution of Texas states: "If any of the officers named herein shall announce their candidacy, or shall in fact become a candidate, in any General, Special or Primary Election, for any office of profit or trust under the laws of this State or the United States other than the office then held, at any time when the unexpired term of the office then held shall exceed one year and 30 days, such announcement or such candidacy shall constitute an automatic resignation of the office then held, and the vacancy thereby created shall be filled pursuant to law in the same manner as other vacancies for such office are filled."[11]

Tex. Elec. Code § 145.001(e) permits a person to run for office and simultaneously be a candidate for president or vice president of the United States. This statute permitted Lyndon B. Johnson to run for vice president in 1960 and, at the same time, seek re-election as United States Senator from Texas. Lloyd Bentsen took advantage of the same provision in 1988 when he was the vice presidential running mate of Michael Dukakis.
