(5,838 posts)As a lawyer, I would NEVER use a title for a litigant that was not actual and current at the time of the filing of the pleading. That is very different, IMO, than the use of a title in an article.
In essence, IMO again, the pleading is stating that a current and present litigant IS the President of the United States.

(179,870 posts)TFG's lawsuit against Michael Cohen is a joke. It is poorly drafted by a three lawyer firm that specializes in franchise law. TFG clearly dictated some of the allegations in this piece of crap lawsuit. TFG has filed a number of bogus lawsuit including suing CNN, the Pulitzer Committee and Hillary Clinton in a Rico claim where TFG was assessed $1 million in penalties.
The key is that the filing is that it shows that TFG is worried.

In the suit Trump filed against Cohen, he accuses Cohen of multiple breaches of fiduciary duty, unjust enrichment, conversion, and breaches of contract by virtue. Trump is basically claiming that Cohen lied about him in public, in books, in podcasts and in other media appearances, and that this breached legal obligations Cohen owed to Trump. But Trump has also alleged that Cohen revealed information covered by the attorney-client privilege.
Hence Trump appears to allege that Cohen divulged truthful information about him that is covered by the attorney-client privilege, but also that Cohen spread numerous falsehoods about him. These two arguments may prove to be at odds. ....
Trumps suit against Cohen may show us no more than how nervous Trump is about the criminal case pending against him.
