Question about 5th circuit decision.

Does the SC need to stay the circuits decision, in order to allow mailing of this drug, while they (SC) decides which way to decide the mailing part of this? Before Tomorrow? (the original judges decision was 7 days)

If that’s the court’s criteria, then no prescription drugs should be available through mail order. Republicans can’t have it both ways, although I’m sure they’ll try.

And appears to be worded to trigger an immediate response/stay by SCOTUS if the fifth tries to supersede Rice’s ruling, or risk a constitutional crisis.

I like Rice’s thinking…this kind of judicial bullshit demands a constitutional crisis to force action.

STATE OF WASHINGTON, STATE
OF OREGON, STATE OF ARIZONA,
STATE OF COLORADO, STATE OF
CONNECTICUT, STATE OF
DELAWARE, STATE OF ILLINOIS,
ATTORNEY GENERAL OF
MICHIGAN, STATE OF NEVADA,
STATE OF NEW MEXICO, STATE
OF RHODE ISLAND, STATE OF
VERMONT, DISTRICT OF
COLUMBIA, STATE OF HAWAII,
STATE OF MAINE, STATE OF
MARYLAND, STATE OF
MINNESOTA, and
COMMONWEALTH OF
PENNSYVLANIA,

So in the above listed jurisdictions there is a conflict and likely the Washington court's decision rules. In the rest, the Texas one does.
