(96,882 posts)Dominion won't settle for simply cash, because without a public acknowledgement that Fox was lying, their voting machine brand will still be damaged and their ability to sell them in the US market will be impacted.

There will not be a settlement without public admissions of guilt, or Dominion is pretty stupid.

(34,919 posts)And, they're going for double what Dominion is asking. I'm sure Dominion will use that in their favor, as well. Lots of individuals lining up right behind them, too. All of them are going to demand a public acknowledgement of wrongdoing. And, not just some schlocky "Ooops! My bad!" crap, either.

(825 posts)Why would Dominion settle if Fox will go on the air and continue to sow seeds of discord about the integrity of their voting machines?
A proper settlement would include all the cash, the jobs of those involved, and continued statements by Fox on air that every time they bring up the 2020 election they must also include the fact that they lied about it.

(782 posts)This is a case where Fox could go out of business or Dominion could go out of business. Going to trial might cause the former, but settling could bring about the latter. Winning would obviously be good for Dominion's business while settling could damage it long term. I think they can't really settle.

There are only two issues being determined by this next phase: whether Fox News knew they were lies at the time they published them (or published them with reckless disregard for whether they were true), and assuming Dominion can prove the first, how much harm did those lies do (damages).
A settlement won't undo the existing summary judgment.
