How likely do you think it will be that SmartMatic gets to trial in the way Dominion didn't?

(7,877 posts)I believe it is in the best interests of Smartmatic to get several witnesses on the stand. For reputation and for a substantial offer north of 1 billion.
Smartmatic will push for an apology and testimony,in my opinion.

(115,899 posts)The purpose of a civil lawsuit is to recover damages for whatever harm the defendant caused the plaintiff, not to advance some social cause or put on a show. If Smartmatic, like Dominion, can get an offer that's sufficient to compensate them while avoiding the uncertainty of a trial and the inevitability of years of appeals, they'll settle, too, and they'd be stupid not to.

But I think either of these companies would do well based on the fact that they have shown they are trustworthy, unlike anything sponsored by the repuglicons/russians.

(38,587 posts)As the Dominion trial drew near, much of the discovery was made public... which gave all of us an idea of what Fox was up against.
I'd say it's highly likely that Smartmatic has access to the same material, especially since Fox and their guests were linking the two as if they were the same company.
I don't know what Smartmatic's financial position is compared w/ Dominion. If they've got more money they may be in a position to hang in longer. If they do stick it out, and win, the jury may not award them what they're asking for. So entertaining settlement offers isn't going to be out of the question.
Jury trials always carry risk. Both parties know that.
Fox will probably be looking to settle from the get-go. They know they're probably going to end up paying out avoiding litigation costs will be just as much of a consideration as keeping its personnel off the witness stand.
On edit: it kills me that they even got dragged into this considering they had no role in the election outside the state of CA. (Powell & Giuliani had to make a link to Hugo Chavez SOMEHOW I guess.) But the fact that their role in the election involved a non-contested state makes the defamation against them all the more egregious.
