In NY, "rape" refers only to forcible sexual intercourse, as opposed to penetration with fingers

or other things.

A reporter on MSNBC said Carroll wasn't positive what he inserted, in addition to his fingers. Without being sure it was his penis, she couldn't prove it was forcible sexual intercourse, or rape.

That's why the verdict was yes for sexual abuse, but not for rape.
