Right to be let alone: Montana Supreme Court unanimously extends abortion rights against latest GOP efforts, rejects excessive governmental interference in womens livesThe Montana Supreme Court unanimously extended abortion protections in the state on Friday amid an ongoing effort by the GOP governor and legislators to erode womens medical rights.
In a 7-0 decision, the Treasure States highest court sided with an advanced practice nurse practitioner and a clinician who challenged a 2005 law that restricted who could provide abortion services.
nder Montanas Constitution, the right of individual privacythat is, the right of personal autonomy or the right to be let aloneis fundamental, the court noted, citing precedent. It is, perhaps, one of the most important rights guaranteed to the citizens of this State, and its separate textual protection in our Constitution reflects Montanans historical abhorrence and distrust of excessive governmental interference in their personal lives.

(20,025 posts)that Montana is not as conservative as you might think. Lot of ranchers out there. They tend to be pretty practical.

(103,799 posts)That is what I found when deciding to move here twenty years ago. Idaho population is a very different story that I got real tired of so I jumped over the state line and have not looked back. I go there a lot but I come home to Montana.

(3,396 posts)Montana is as fucking dangerous as it comes. I am there a lot and know lots of people out there. Including rancchers all up and down from Missoula down to darby over to wisdom, jackson, the big hole, dillon.
It is absolutely LOADED with nutjobs. Didnt used to be that way but it is now. Know a gamily out there that has had to move and try to conceal that they are jewish. Outside of missoula and other college towns it is an absolute hellscape.

(8,659 posts)The GOP insist this is one of several reasons why we need a state convention to rewrite the constitution. Polling suggests better than 75% of ALL voters disagree with that notion.
There is mixed opinion about different parts of the Constitution but virtually NO ONE trusts that the current State Legislature or Governor will actually improve it.
The general wisdom runs that too many of them have vested interests in making changes that would harm the state in favor of property developers or Big Mining at the cost to Montana Citizens and our quality of life here.

(114,650 posts)I'm telling ya, some of these mountain states can shock the hell out of you.
Their SC was absolutely correct, these stupid laws are a massive government overreach into the personal lives of half the population plus their families, not to mention a massive violation of the anti establishment clause since they're all basically based on a misreading of one ill considered bible verse.
Here in NM, they just got all the old religious laws off the books a year and a half before TFG;s stacked court made their stupid decision.

Kinda hard for a marsha Blackburn type humanoid to argue against that logic.

My favorite author, James Lee Burke lives in Missoula but most of his books are set in South Louisiana. Highly recommended if you like flawed good guys and bad, bad guys who get their asses kicked in the end (metaphorically)

(103,799 posts)Use this as my basic argument to magats when I have to deal with them. Seriously freedom is represented by this point in our Constitution so they can take that and reassess their idea of freedom.
If they have freedom for activities they feel they need to participate in, then the rest of us have the freedom to do what we feel we need to do. If it is terminating a pregnancy for whatever reason, that's nobody else's fucking business, am I right?
And I will hear no argument otherwise because freedom.

(8,238 posts)want a chance to rewrite the constitution so they can make major changes in how our state is run. They are one scary bunch. Most Montanans are pretty much of the "just leave me alone and I'll leave you alone" variety but the newly elected MAGA crowd wants to turn Montana into Idaho.
