Why would anyone still be looking for "intent", when the documents were stolen and hidden from the DOJ? What more "intent" is needed than the fact that they were stolen and hidden, in violation of the Espionage Act? How much more "intent" do you need? When he stole the documents and hid them from the Feds, what else do you need to know about what was in his head?
