Calls are growing for the arrest of a woman accused of shooting her neighbor Friday in Florida in an incident a nationally renowned civil rights attorney described as an “unjustified killing.”

The children of the victim, identified as Ajike “AJ” Owens, were playing in a field near an apartment complex in Ocala when, attorney Ben Crump said, an unidentified white woman, 58, “began yelling at them to get off her land and calling them racial slurs.”

According to Crump’s statement, after the woman yelled slurs at Owens’ children, they accidentally left an iPad behind, which the woman took.

When one of Owens’ children went to retrieve it, she threw it, hitting the boy and cracking the screen. Owens walked across the street to speak to her neighbor after she learned what happened, Crump said.

“She knocked on the door, and at that point, the woman allegedly shot through the door, hitting AJ, who later died from her injuries,” Crump said.

The way these idiotic "stand your ground" laws are worded, the police may not have a whole lot of discretion. They may be required to consider "stand your ground" as a positive defense before taking anyone into custody.

In other words - they may not be simply choosing not to arrest the killer in this case. They may be trying to figure out if they're allowed to.

Not saying the police are acting appropriately here. Not saying they're not, either. I don't know either way, at least as far as the letter of the law is concerned. (Morally, they're clearly off.). But these laws were designed to tie law enforcement's hands, and this may be a case in which it's working.

It's my firm belief that Florida will be the first state to overturn these stupid, stupid laws. Someone's going to shoot a tourist from abroad and walk because of "stand your ground." The defense may be ludicrous - any appearance of an altercation may have been caused by a language barrier, for example - but the law is intended to let ludicrous defenses work. There have been travel advisories against visiting Florida because of the gun violence, but we'll see advisories with real teeth when (not if - when) it happens.

One thing we've learned over the past couple of months is that the tourist industry in Florida - and certain tourism companies with rodent mascots in particular - carry more power than the state's governor and probably even the NRA. International tourism dollars will diminish, they'll demand action, and they'll get it.
