Thinking of sending an unsolicited nude? Think again, say Michigan Dems.
The act of sending an unwanted nude photograph in Michigan could soon end up costing you and not just from a relationship standpoint.
Under House Bill 4535, a person over the age of 18 who knowingly sends either a sexually explicit video or photo by text or electronic message such as email or through a social media app could see a $500 fine if the message is sent without the other partys consent.
The person who receives this unwanted message could also bring a civil suit, recouping damages for emotional stress or other appropriate relief, against the person who sent the message under the bill.
Rep. Lori Stone, D-Warren, said she sponsored the bill in the hopes of cracking down on whats known as cyberflashing or the act of sending obscene photos to strangers, typically through Apples AirDrop feature.
(Its) people who are looking for a reaction, to be able to see someone open a file and see their reaction usually in a public venue where adults, anyone, might come across it and not know what theyre looking at, she said. You go, you see somethings been AirDropped to you and ... then you end up with something of a rude awakening.
