The Espionage Act violation under which the Rosenbergs were tried, convicted and executed dealt specifically with the disclosure of information to a foreign government of agent of a foreign government with the intent or reason to believe that such information is to be used to the injury of the United States or to the advantage of a foreign nation.

From what is being reported, and what seems most likely, Trump will be charged with a violation of a different section of the Espionage Act -- either 18 USC 793 (d ) or ( e). Those provisions, which address the retention of sensitive information, are subject to a maximum penalty of ten years in prison.

So, no, the "precedent" is not clear. It isn't even a precedent.

He may very well have done more than "retain documents".

Jared didn't get that $2 billion for his brilliant business skills & you know Trump got a cut. Hopefully, the evidence is there.

than the one addressing retention of documents, that information would be coming out.

We'll know on Tuesday (if not before), but my bet is that the only Espionage Act related charge is the unlawful retention violation.

and I don't believe in the death penalty. But I would enjoy Trump worrying about it - especially as it was his administration that began executing people after the Federal death penalty had not been used for 20n years.

Roy Cohn pushed for the death penalty for the Rosenbergs.

Now his protégé, the son he never had, is getting caught in the wheels of justice. I just don't want to hear his name again.

For a long time I just refused to believe he had a chance at prison. Now I think it’s a greater than 50% chance he serves time.

but there is some Karma here when you consider Trump started using the Federal death penalty again after it had been dormant for almost 20 years.
