On Monday, Florida Governor Ron DeSantis signed a bill into law that ends permanent alimony in the state, a move that has sparked controversy and debate.
What Happened: The new law, which takes effect starting Saturday, eliminates permanent alimony, restricts the duration of alimony to a maximum of 50% of the length of the marriage, and allows for modifications in alimony payments in certain situations, CBS Miami reports.
The law also includes a provision that would make it more difficult for judges to award alimony payments that exceed 25% of the payers gross monthly income.

DeSantis actions and policies have sparked controversy and debate. His decision to end permanent alimony in Florida is likely to be a contentious issue, with critics arguing that it could leave some spouses, particularly women, in a vulnerable financial position.
We believe by signing [the bill], he has put older women in a situation which will cause financial devastation, Jan Killilea, a 63-year-old Boca Raton woman who founded First Wives Advocacy Group a decade ago, told The News Service of Florida Friday, according to CBS News.
The so-called party of family values has just contributed to erosion of the institution of marriage in Florida.

(17,516 posts)The mom is usually dealing with the emotionally devastated teens, college age kids.. then she is trying to help the depressed offspring who are suffering after watching dad leave them and the family for the new girlfriend. Except she wont have time to attend to them, she will be triying to work 2 jobs to pay rent or mortgage,or maybe the kids lose their home too, the one to go back to.

(27,633 posts)This is not eliminating alimony, its eliminating permanent alimony. Until today, only seven states provided for permanent alimony. Now, its down to six. Many of the most prominent blue states (including California, New York, Massachusetts, Maryland, and Washington) havent offered it for many years.

(a) Except on written agreement of the parties to the contrary or a court order terminating spousal support, the court retains jurisdiction indefinitely in a proceeding for dissolution of marriage or for legal separation of the parties where the marriage is of long duration.
(b) For the purpose of retaining jurisdiction, there is a presumption affecting the burden of producing evidence that a marriage of 10 years or more, from the date of marriage to the date of separation, is a marriage of long duration. However, the court may consider periods of separation during the marriage in determining whether the marriage is in fact of long duration. Nothing in this subdivision precludes a court from determining that a marriage of less than 10 years is a marriage of long duration.
(c) Nothing in this section limits the courts discretion to terminate spousal support in later proceedings on a showing of changed circumstances.
(d) This section applies to the following:
(1) A proceeding filed on or after January 1, 1988.
(2) A proceeding pending on January 1, 1988, in which the court has not entered a permanent spousal support order or in which the court order is subject to modification.

He lives in Dublin, CA (this is where he was raised, and their kids were raised til a couple years ago), a VERY expensive to live.
She cheated on him, having affairs with doctors and other medical people, lying about working late shifts, etc.
When they divorced, she moved to her parents house out in Modesto, where she lives rent-free. The kids now go to school out there 80 miles from where they grew up going to school, had friends, etc.

Yep, you guessed right.
There's times alimony is appropriate, but it's also a whole lotta fucking bullshit in other cases. And probably 90% of the time, it's the man paying it, just because.
Funnily enough here in freaking Arizona, it's harder for somebody to get alimony than it is in CA.

(note: I supported my ex-wife financially our ENTIRE MARRIAGE, and even before ... while she pursued her dream of being a famous clothing designer ... which didn't happen. To her credit, she did not even ask the court for it, however, given the circumstances).

But she (and her family) have money and a good lawyer.
This is my half-brother, son of our late dad, who was always broke (as is his mother, who's thankfully still around and a wonderful nana to the kids).
I at least have my birth mother and step-father, who have done very well for themselves, and helped me out with my lawyer, etc. My AZ divorce was very fair and equitable. Not the case for my bro in CA.
