When we spoke with John Haggard of Charlevoix, another defendant, he had not yet gone through the charges.
I have no idea what shes filed, Haggard said.
He said he doesnt understand why Nessel filed charges and believes its for publicity.
I signed a paper that said that Donald Trump won. I guess she doesnt believe in the First Amendment in order that I can say what I want to say, Haggard said.

(4,741 posts)After having qualified for Mensa and attended some meetings, I can assure you that some of them could have indeed been among the membership.
They may have been smart enough to pass the Mensa test, but smart in the more understood interpretation of the word, they weren't. Not all of them, that's for sure.
But if it were a test of pomposity for admittance, well, that's one test too many of them passed with flying colors.

(24,438 posts)This idiot knows what he did, he didn't just sign a piece of paper saying Trump won, he tried to substitute his own name as a replacement for the legal elector. They knew eactly what they were trying to do and this defense will be laughed out of court.

(3,245 posts)There was something that I noticed about Kathy Berden since her name has come up several times.
On every document, she lists herself as Chairperson of the Electoral College of Michigan. Unless named otherwise, would not the Michigan Secretary of State be the "Chair" of the Electoral College (and is there such a thng?) who is responsible for certifying the results. I'm mentioning this since when you look at the envelope it was mailed from she lists her as Chairperson of the Republican Electoral College of Michigan. There's a big difference.
If this is a big deal, has she set herself for severe federal charges?

(24,438 posts)Their defense is total BS, but they know their voters will buy it. This wasn't signing a statement of who they thought won, this was an attempt to forge a document to award the elctoral votes in Michigan, and they didn't stop there, they took this further.

(20,388 posts)They signed fraudulent legal documents declaring themselves duly recognized electors. He just admitted to it and the prosecution can and will use that in court. The First Amendment does not cover fraud, period. Hes either the stupidest criminal ever, or just plain stupid. Neither is a good defense strategy.

(7,794 posts)Why hasn't the DOJ gone after these guys? They're not smart enough not to leave a trail leading to their offices. Is this about the justice department being confused about what is illegal and what is not, what is in their jurisdiction and what is not? Are there enough Eastman believers in the DOJ to allow this treasonous attack on our elections to go unpunished, as if it weren't even controversial?
You know, if it's ultimately proven constitutional that it's exclusively the power of the states to police the electoral disposition in their jurisdiction, it's the same as saying Eastman was correct. Because it looks like the party could send (to Washington) the governor's housecat with a note on his collar stating the disposition of the state's electors and, unless the state AG fights it, the governor's party gets to do whatever they, or the cat, think they can. The national board of electors may throw a fit but they're not, after all, sovereign states.
Trump is walking through the holes in the constitution and showing folks how easy it is. That's not good, especially since so many people believe the constitution is a done deal document. Perfect and complete, infallible and right, from its inception, a document handy for fighting all social battles in court or in the streets.

Furthermore they aren't being indicted for saying or believing he won. It's about making a false claim about being an elector and swearing to statements known to be false.

I gave it a second glance today, after reading the article in the OP.
It looks like what they did at their meeting was:
They signed a certificate saying that they were the "duly elected and qualified Electors for President and Vice President for the State of Michigan"
It looks as though some of the real Trump electors were not present at the meeting. So they appointed fill-ins for the Trump electors that were not there, and signed documents saying that they were legally appointed to be Trump electors.
I thought I remember some hullabaloo about these guys trying to get into the Capitol Building in Lansing and being turned away by law enforcement. I guess there wasn't enough of a ruckus made for Nessel to decide to make any charges against these folks for trying to disrupt the whole process.
