This is called the "Speech and Debate" clause of the Constitution, and should have been mentioned in any high-school level civics discussion of the Constitution.
It is one of the really basic principles of the Constitution.
It's amazing to me how quick people are to toss it away when they feel like it.

And they tend to be extremely unattractive as well - Donald Trump, Bill Barr, Steve Bannon, Stephen Miller, Mitch McConnell, Chris Christie, Mike Pompeo, Ron DeSantis, etc. The only way most of them can attract a woman is with power and money. I think that is often the primary reason they hate Democrats so much.

(53,270 posts)but as you say, they are outliers. I didn't even realize it until years ago when I saw a really handsome political consultant on TV and I was shocked to find out he was a republican. Then I began to notice that most of them were quite unattractive. There are a few who are conventionally attractive, but once they start talking, their looks tend to fade.
I agree that Romney is an attractive man and a relatively decent guy, but a little clueless. Darrell Issa (especially when he was younger) is good looking, but it only takes a short time to realize he is a snake. My first impression of Paul Ryan was he was kind of cute, though after awhile I found him a bit goofy looking. That said though, most of them really are rather ick.

Runners up: Rudy Giuliani, Stephen Miller, and Steve Bannon. However Bannon was surprisingly good looking when he was young. I guess over the years, his inner self came to the surface.

Does the invasion of privacy and sharing of images obtained through a third party merit some legal recourse?
Otherwise, it seems like they could just go out and publish any nude/sex act on the floor (or in committee) on any of their fellow congress people, or any random person they don't like. So people should go out and spy on/film others (or steal someone's personal data), give the vid to a congress critter and you're golden?
This seems above and beyond debate. As many have mentioned here, it appears more like revenge porn (even though Hunter and Marge haven't done nasty together).
What are they debating here and what relevance does Hunter Biden having sex on camera have in this debate?
You say that D.C. laws cannot apply here. Would there be a federal status she is violating?
Just repeatedly posting the Article doesn't really help giving any context other than there's a certain level of immunity. Committing a felony is not protected. Is revenge porn or invasion of privacy (which this seems to include) only a misdemeanor federally?

Yes, those were misappropriated state secrets - which is categorically more sensitive that someone's nude pictures. And, yes, it would have been a violation of federal law but for the fact that he was a Senator engaged in a speech in the Senate. Period. End of story.
They tried it against DEMOCRATIC Rep. John Murtha when he referred to a massacre in Iraq as a war crime.
I expect the other side to piss on the Constitution. I don't expect our side to do it.
Is she a Congressperson? Yes.

(1,358 posts)just seems like, despite constitutional protections, the constitution is not absolute, there are exceptions all over the place for felonies and treason as mentioned.
The Article specifically mentions those exceptions, so if a congress critter committed a felony, then they should be prosecuted (no matter what side of the isle they stand on).
Whether this would be a felony, I'm not sure about federal law around publishing misappropriated nudes. The Article does specifically mention commission of a felony.
If it's blanket immunity as seems to be implied by your argument, then I suppose, as long as you're debating, you can also shoot someone on the floor? You can commit all sorts of heinous crimes, but as long as you're actively debate, it's all good?
That just doesn't make sense.... If invading someone's privacy, showing misappropriated/non-consensual nudes of a private citizen, is not a felony, then hey, have at it....
According to Meidas Touch, per D.C. law it is only a misdemeanor. He cites the specific code in the video. Ben Meiselas makes some good points why Marge could still land in hot water about this (granted it's extremely unlikely to happen even if she were found not to be protected by the debate clause).
I don't get how this kind of thing is allowed on the floor of Congress (or in committee). It doesn't seem that Marge was debating much of anything (though I guess 'debate' is intentionally vague to allow for loopholes like this).

Good news: she apparently emailed copies out to constituents in her enewsletter, and in Hutchinson v. Proxmire, 443 U.S. 111 (1979), SCOTUS said the Speech and Debate Clause doesnt extend to newsletters. 😀
