Ex-US attorney: Jack Smith "may need to politely tell Judge Cannon to butt out" after latest order

U.S. District Judge Aileen Cannon on Monday asked special counsel Jack Smith about his use of an out-of-district grand jury in the classified documents case against former President Donald Trump.

Cannon, the federal judge in South Florida assigned to the case, is demanding answers from Smith on the "legal propriety of using an out-of-district grand jury proceeding to continue to investigate and/or to seek post-indictment hearings on matters pertinent to the instant indicted matter in this district."

Most of the classified documents case is being handled out of Cannon's district in South Florida, but some grand jury work in the case was also conducted in Washington D.C., where the former president was also recently indicted for his attempts to overturn the 2020 election.

Cannon took issue with this and questioned why a grand jury heard evidence in D.C. after Trump had already been indicted by a grand jury in Florida, demanding an explanation from Smith by Aug. 22.

"Based on her order, it appears that Cannon is crossing into the government's lane," former U.S. Attorney Barb McQuade, a University of Michigan law professor, told Salon. "Under the constitutional separation of powers structure, the executive branch has sole authority to investigate and charge criminal offenses. There is no reason the special counsel cannot investigate related charges in other districts."

Tr**p had access to these documents while in the WH in D.C.. The documents were boxed and taken to FL in D.C..

Wouldn't that fact be all the justification to have a Grand Jury in D.C.?

The documents ended up in Mar a Lago, but the underlying activities began in DC along with the National Archives request for return of presidential records.

at his New Jersey golf club with top secret war plans...and like you said, the documents theft originated in DC ...I suspect Trump ass-crawler Aileen was experiencing "FLO'' (feeling left out), ignored by Jack Smith and the media, and so she pulled a "Look at me!" and did stupid...

comment was an end run to tell Cannon what to do.
TFG's present lawyers did not tell her what to do but it's ironic the day after he mentioned this, Cannon did just that..
Hummm is this possible or am I just getting too "out there"...
I just think it's a coincidence.

She has been assailed for her latest action to an extent that it’s so hairbrained it sounds like it’s coming from Trumps 3rd string JV legal team.

Live here and went down to the beach, the breeze was as warm as the temp which was in the triple digits. Only stayed about 45 minutes then went back home. Not really enjoyable.

It was a footnote in her order. Worded something to the effect of nothing in this order precludes defendendent from filing a motion under section 12(b)... (I think that was the section).

The section she references includes causes for dismissal. Wink wink, hint hint.

So she appeared to be inviting them to use the grand jury issue to file for dismissal.

We are having some fun now.

I wish more in the media would recognize this fact. Calling it a documents case, minimizes the very serious nature of the matter.

than a national security case. And that's very important to our media. By their standards and methods, both parties must be equally guilty of all or any infraction for which the GOP is guilty. Only Democrats can be guilty of stand-alone violations. The typical ratio is 10 unsubstantiated rumors of foul play by Democrats for every actual law broken by Republicans. Because it's a proven fact that it requires 10 news cycles repeating grossly false and overblown rumors of Democratic fouls to dilute a single factual account of Republican lawlessness. Do you have any idea of how many hours of head-in-the-sand reporting is required for that system to work? But if that's what it takes, the American media is up for the task. Every network wants to be broadcast on military posts throughout the world. It's a trophy thing. And no base, or even top, commander is going to allow too much criticism of the Republicans who provide and maintain the MIC. That shit gets out among the grunts and the lid comes off the whole charade and its goodbye effective deterrence and we're vulnerable to another Pearl Harbor fiasco call to arms.

All that bother just to keep the American people informed about the true nature of their government and its media dependency? Really, where are your priorities?

Oh, and yes, there's a good bit of sprinkled in this missive.

The findings might well be pertinent, but can see judge asking.

Also sounds like this will be resolved within 2 weeks.

She probably doesn't know how evidence is gathered to begin with. She'll just have to take SC Smith's word on that until he submits some more on discovery. That will be a test.

Because he could be holding evidence of crimes to the north to see further how she, Trump, and his FL counsel behave. She already denied additional evidence brought by his team (two of the best espionage trial lawyers in the country). If she rejects it he can file another indictment on other aspects of this national security case in NJ and/or DC, depending on who he's indicting -- this time, probably Trump and co-conspirators.

They were created and marked "classified" in that "out of state" venue of D.C. metro, and then were insecurely transported across state lines (commerce clause) into other jurisdictions, where who knows who the hell they were shown to (and we saw how many of them were "stored" ).

IIRC, one of the charges against FOOL* is retaining stolen classified nat'l security documents. That crime occurred in Florida.
