In one of several potential indictments against Donald Trump, evidence from his own wife may seal his fate, according to reports. Trump is set to defend himself in courtrooms in New York, Washington, Georgia, and Florida related to alleged illegal activities during his presidency and his involvement in the January 6 Capitol insurrection. And in the New York iteration of his legal battles, uncovering Melania Trumps emails is allegedly a main goal for district attorney Alvin Bragg and his staff.
The felony indictment against the former president, 77, accuses him of faking business records to hide a $130,000 payment to adult film star Stormy Daniels during his 2016 presidential campaign. Trump has denied Daniels claim that she had an affair with him in 2006 while Melania was pregnant with their son, Barron. She also alleges that she was paid to keep quiet about the alleged fling.
A source tells Radar Online that emails sent by Melania in the aftermath of the alleged affair becoming public could be a smoking gun in the trial as the former model allegedly did not hold back in displaying her heartbreak and plans to divorce Trump. Shes likely written multiple emails to counsel asking for guidance on her rights if her husband is convicted on all these charges, and if she should use whatever she knows to squeeze him in divorce court, a source close to the Trump family told Radar Online.
In July, a judge denied requests to view Melanias emails but the pursuit is allegedly not over for Bragg. Those emails could make Melania relive the entire betrayal again in the public eye, an insider alleges. It also would reveal what she knew about the affair along with many other humiliating aspects of her husbands business and personal life.
The last thing she wants is for people to know how much her husband put her through and her fraught relationships with Donalds children, the source continued. Theres no way the family could survive that kind of public humiliation! The emails hang the ex-president out to dry. The source claims Melanias emails could add to growing speculation that her relationship with Ivanka Trump and Jared Kushner is fraught.

She's free to do so if that's her choice.

She doesn't have to verify authenticity, though she is free to deny it under penalty of perjury.
It's the same theory a court can use to force you to give up an encryption password to a file. It doesn't amount to self incrimination. You are just surrendering evidence.
Emails won't fall under spousal privelage. Not sure about attorney client priv, but she probably didn't mark them as privelaged so that might exclude them.

(12,002 posts)That requires a witness, unless the parties stipulate to the admission of an exhibit. Trump isnt going to do that.
If she was seeking legal advice from her attorney, thats privileged, whether its marked so or not. Conversations with an attorney within the scope of the representation are privileged, and they certainly arent marked.

(12,002 posts)Hearsay is defined as An out of court statement offered to prove the truth of the matter asserted. It could conceivably be offered for some other purpose, and there are also 24 enumerated exceptions to the hearsay rule in Rule 803. I doubt any of those apply.
In addition, the assistant could testify he or she received it, but probably not that they have personal knowledge that she actual wrote it.

It's a privilege of confidentiality for Melodrama. So she can testify if she wants to. Doesn't have to if she does not want to.

(20,453 posts)The emails the prosecution is looking for as evidence are older ones that were sent in the aftermath of the alleged affair. Not sure if they were sent to him or others (friends?)
She is also, right now, emailing her lawyers about how to proceed if he is convicted. I dont think they are seeking those.

(12,002 posts)to her would be admissible as an admission of a party opponent, which could be a vehicle to get hers in. Youd still need a witness to lay the foundation for admission.
If she is still supporting him, as the article says, she would likely invoke spousal privilege. He cant be called by the prosecution. Who else can authenticate them?

As for the rest of it...public knowing, humiliating, etc. EVERYBODY in the universe already knows all about that orange pig. If she hasn't been humiliated by now, she never will be.
