Tiedrich: holy shit, these Federalist Society lawyers want to 14th Amendment the fuck out of Donald

https://www.jefftiedrich.com/p/holy-shit-these-federalist-society?utm_source=post-email-title&publication_id=1162742&post_id=135916727&isFreemail=true&utm_medium=email

the complete text of Section 3 of the 14th Amendment of the United States Constitution, ratified in 1868 in the wake of the Civil War, reads:

“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”

“engaged in insurrection or rebellion.”

hmm. does that sound like any fuckface former president we know?

Snip

but do you know who else it seems obvious to? William Baude and Michael Stokes Paulsen, two law professors from the Federalist Society.

holy shit. the Federalist Society. that’s huge.

“The bottom line is that Donald Trump both ‘engaged in’ ‘insurrection or rebellion’ and gave ‘aid or comfort’ to others engaging in such conduct, within the original meaning of those terms as employed in Section 3 of the 14th Amendment.”

“Section 3’s disqualification rule may and must be followed — applied, honored, obeyed, enforced, carried out — by anyone whose job it is to figure out whether someone is legally qualified to office,” the authors wrote. That includes election administrators, the article said.

again, holy shit.

Also, I wonder how and when they'd invoke that 14th Amendment clause?

The repub national convention would be the perfect place IMO.

has gotten all his legislation passed he can dominate the spotlight and have Dems and repubs trying to woo him.

Let him, though. If he switched to Indy it won't be so easy to get reelected in W. VA. And Sinema most likely won't be around to join him in a mini-power block scheme they've been running, as she probably won't get reelected in AZ.

Go ahead, Manchin. Give it a shot. See what how much power a lone indy in the Senate can wield.

They know Trump has no chance in the general election. But they also know Trump is almost certain to get the nomination.

DeSantis has already put a Federalist society member on the Florida Supreme Court. They want Trump out of the way so that DeSantis can get the nomination.

If Trump wins the nomination it pretty much guarantees that Biden will win. It also is likely to reduce Republican turnout overall as there are significant portions of the party who are done with Trump. That will hurt them greatly in other races for the House, Senate, etc.

The earlier they get rid of Trump the better position they are in. That is their motivation.

47. I wrote to my Secretary of State twice about 14th amendment
Sat Aug 12, 2023, 07:37 AM
Aug 2023

A month ago, I wrote to the Connecticut Secretary of State about this 14th Amendment rumor. A robot answered my email. Yesterday, I wrote again to Santasha Pena, but only a software robot replied. Did you notify your state elections official?

"Dear Secretary of State Pena,

My name is Alan Folmsbee. I live in Bristol, Connecticut.
Please keep the insurrectionist, Trump off any ballot.
The 14th Amendment to the U.S. Constitution "is clear that
anyone who takes an oath of office and then engages in
insurrection is forever barred from holding public office
again". No trial is needed to know Trump is a traitor and always
loves Russia in his statements.

In my 71 years, I have seen many poor people go to jail
for no reason. I seldom see rich criminals have justice
delivered. Please show that the Law means something
to you. Keep a known insurrectionist off the ballot. Your inaction
would mean you support and defend insurrectionists.
Do your duty. The mob-boss former president is
calling for murders of state workers. This is too serious
to ignore. Announce your goal publicly, soon:
Choose a goal: protect an insurrectionist or protect democracy.
If email means nothing to you, I can write a letter.
Please do not ignore me again. I can meet with you and the legislature
to discuss the Constitution."

DeSantis is a friend of the Federalists. He has put one of them on the Florida Supreme Court already.

They know Trump is a liability at this point. The earlier they get him out of the way the better for them in the upcoming elections.

Do not think for one moment they are doing this because it is the right thing to do. This is a strategic move on their part.

any prohibition to Trump being on the ballot. So, no, there will not be a 2/3 majority in the Senate in favor of having Trump on the ballot.

But that assumes that he would actually be removed from the ballots based on his insurrection activities.

This is a strategic move on their part to get Trump’s liabilities off the table. The earlier they do it the better it will be for them.
