Judge Chutkan rules Trump will be forbidden from having a phone, copy machine, or anything else that could create a copy of the sensitive materials while he's reviewing them. Defense counsel will have to review Trump's notes to make sure he's not copying witness' personal info.

Our nation needs a civics lesson every step of the way to show how far out of the norm and criminal Trump truly is.

(17,830 posts)Will he have to go to DC to review documents? There should be witnesses (nobody associated with him) in the room other than his lawyers to be sure no phones are used. Better yet search him and his lawyers for phones or recording devices before they are allowed to see documents.

or other photographic device on him? Will somebody frisk him before and after he reviews materials? Allowing Trump to view materials alone, without attorneys present, is an invitation to his criminal mind to sneak in a concealed, tiny camera, or to hide notes in his clothing and show only acceptable ones to his attorneys for review. It also allows his attorneys to decide what is too sensitive to copy.
Will there be surveillance cameras in the space where Trump reviews the materials? I think that should be required.

AFAIK, the DC J6 indictment does not involve materials that require a SCIF. The restrictions being imposed are for the purpose of preventing Trump from using investigation records, names, and testimonies to intimidate witnesses and potential jurors.

(4,741 posts)That would defeat the purpose of discovery: Each side gives each other what they have, and then they review it all separately, to look for flaws in the analysis and legal readings of that information.
If you let the prosecution look in on the defense reviewing that information, it would be the equivalent of a casino house not only dealing the cards, but then getting to look over your shoulder at what cards you're playing.
The defense lawyers will have to keep an eye on him.

If you know how to read legalese, she's not being mild at all. She's laying down the rules for him, and letting him know there will be consequences if he yanks her chain. She literally put him in a box for what he and his hack lawyers can do with discovery information regarding witnesses and jurors.
She's also handling him in a way that will make it really--really--hard for him to have any wiggle room for an appeal. If she came out throwing the book at him, that would give him room for it. By giving him a slack leash in the beginning, and now starting to reel it in, she's closing his avenues for a legit appeal. She's giving him the option not to be stupid, but if he insists on it, well, the leash will get shorter and shorter until he's well within FAFO territory. But never be in doubt that he's on a leash, and she's holding it. Because when he FAFOs after he's reined in al the way, she will then have given him chances to behave right, and it will be only his fault when she makes him pay the price for being stupid with her.

The court and prosecution will not be able to prove that it was Trump or his attorneys that leaked the info, so he will get away with it. He will claim that it was Judge Chutkan or SC Smith who leaked it.

And it's not like the people around him have any more loyalty to him than he has to them. It won't take much to get one of them to rat him out.
Besides, these are stupid people. Subterfuge and nuance is not their forte.

I dont think this contrarian reality of his has gotten through to people. He sincerely believes that NOBODY can tell him what to do. And he will have to be brought to heel - by force if necessary, He will try to mess things up ANY way he can and as long as he can say or insinuate ANYTHING to Tai t the jury pool, hell find a way.
