My dad was career military and he always said that he didn't work for the Air Force,
he worked for the American people.
That always made a big impression on me as a child.
So a child could understand what public service is, but the GOP cannot.

(1,493 posts)...gets his case heard in federal court based on the fact he was performing official duties as a federal official during the time of the indicted behavior. He would still be tried by the state, under that state's laws. The biggest thing this will do is expand the jury pool from just Fulton County to the Northern District of Georgia.

...Meadows is petitioning a federal judge to have his case removed from Ga. state court to federal court.
He has a hearing on removal from the state case in Ga. District Court scheduled for Monday, August 28, 2023, at 10:00 A.M.
He's asking the Ga. District Court to 'remove' him from the State RICO case because of harm he claims he'd incur WHEN, he says (not if) a federal judge would grant him the immunity he's seeking from arrest that he says 'federal law affords former federal officials."
He's arrogantly telling the court here that it would be more 'efficient' for them to grant him removal from the case now, and avoid his arrest which he's optimistically claiming will be repudiated sometime in the future by the federal judge he's appealing to.
His lawyers go on a bit about their superior knowledge of Ga. law and their psychic abilities to predict the federal ruling.
Bottom line, Fani wants his ass by Friday, and this is an emergency appeal to the Court to grant immediate removal to prevent what he calls the harm his arrest will cause which he actually describes as more of an inconvienience for the court.

(179,869 posts)This motion is very arrogant. Meadows filed to remove to federal court. That statute provides that the state criminal proceeding continues until the case is formerly removed. The federal court ruled earlier that Meadows motion is sufficient to avoid an immediate dismissal and set a hearing for Monday of next week
Meadows motion simply assumes that Meadows is entitled to immediate removal to federal court or a stay. I hope the judge rejects this motion

This part of the motion is really concerning
case, not just the charges against Mr. Meadowswhether or not other defendants
wish to remove or have a legal basis to do so. See Heinze, 637 F. Supp. 3d at 1325
n.8 (It is well settled that if one claim cognizable under Section 1442 is present,
the entire action is removed, regardless of the relationship between the Section 1442
claim and the non-removable claims.) (quoting Nadler v. Mann, 951 F.2d 301, 306
n.9 (11th Cir. 1992)). Mr. Meadows, of course, had no control over how the case
was presented to the grand jury and seeks removal only on his own behalf. A district court
court may remand proceedings against remaining defendants after dismissing
charges against federal officials, see Spencer v. New Orleans Levee Bd., 737 F.2d
435, 438 (5th Cir. 1984), and at least one has severed a case after permitting removal
and then remanded the non-removable portion to state court, see Joyner v. A.C. & R.
Insulation Co., No. CIV. CCB-12-2294, 2013 WL 877125, at *9-10 (D. Md. Mar.
7, 2013). But however the Court should proceed, Mr. Meadows has an absolute
right to have the charges against him heard in federal court, Willingham, 395 U.S. at
406, and the Federal Officer Removal Statute calls for prompt consideration of his

(94,264 posts)...U.S. District Judge Steve C. Jones (Northern District of Georgia) will decide this a little over 40 hrs. before Meadows is due to be arrested.
