**seems the woman thought pulling the magazine would unload all the bullets** still a very shitty thing to do, to scare a 4 year old with possible death.

Killer who pressed loaded gun to scared 4-year-old girls chest and pulled trigger claimed firearms safety lesson: Prosecutor
Prosecutors in the office of 9th Judicial District Attorney General Russell Johnson allege that Breanna Gayle Devall Runions shot and killed Evangaline Gunter on Sunday at a residence in Rockwood, Roane County, where Runions, another unidentified woman, and a second child were present. Neither woman was a parent to the children.
When police arrived on the scene, Runions told officers that the shooting took place while she was showing the child firearm safety, according to an arrest warrant obtained by Law&Crime.
Runions removed her Taurus Millenium 9mm handgun from its case, then removed the magazine. Runions related that she then called Gunter over to show her firearm safety, at which point she pressed the barrel of the gun into the front of Gunters torso and pulled the trigger, discharging a round into Gunter, the police report states.
If its true that the magazine was removed when the gun was fired, then it would seem there was still a bullet in the chamber.
The defendants reported explanation, already suspect in the eyes of investigators, looked even worse after the other woman in the home allegedly told authorities that Runions punished the children that Sunday morning for not waking them up and for eating the second womans food.

(11,987 posts)1. Every gun is always loaded.
2. Never point your gun at anything you dont want to destroy.
3. Keep your finger off your trigger until your sights are on your target.
4. Always be sure of your target, and whats behind it.
This is rank stupidity.

(11,987 posts)That wont be a defense to manslaughter.

(17,802 posts)I don't know the legal term for killing someone in a fit of anger, like shaking a baby or pushing someone down stairs.

If she wasn't trying to kill the child, she surely didn't give too much of a shit if she did because every action she took (and didn't take) ensured that result.
Now a baby is dead and a family gets to live forever in that gun-humper's hell.

(11,987 posts)That is idiocy, which caused a death for which she will be punished, but I do not see intent to kill.

(71,542 posts)them to point guns at others...as my dear old Dad used to say don't point guns at anyone and don't assume it is empty ever ever. I think she killed the kid on purpose and leaving the round in the chamber was deliberate.

(6,943 posts)It's also why some handguns have what's called a "magazine disconnect safety," meaning that when there's no magazine in the gun, it won't fire even if there's a cartridge in the chamber. The question becomes to what degree technology can save us from staggering stupidity and criminal negligence. I think the answer is "a little, sometimes."

(14,106 posts)Who placed these poor kids with this monster?
herding cats
(20,047 posts)But, I do hope they're held responsible as well. Poor, little babies were being abused and one lost their life. At just 4 years old. It's indefensible.

(20,047 posts)There's zero proof the clip was even removed. Even if it was, you should ALWAYS check to see if a shell is in the chamber. Period. Which doesn't begin to speak to the insanity (intentional terror) of placing that gun against that little girls chest and pulling the trigger, which should never ever be done. Let alone to a tiny 4 year old child to teach them "gun safety" and that's if her deranged story is to be believed.
Her story doesn't hold water and frankly stinks like a week old fish.
It reads as if she meant to terrorize the poor child and either pulled the trigger accidentally or intentionally. Either way it's sick and that little child was no doubt petrified with fear before she died.

(72,121 posts)When we were doing rifle training, even without live ammo, every time we returned our rifles to the arms room, we had to pull back the charging handle and inspect the chamber to ensure it was empty.
That was to get us used to checking the chamber. Every. Single. Time. To make it second nature.
Thats why Ill never trust these armchair warrior, Rambo-wannabes and their ridiculous simulacra of firearm safety classes.

Straw Man
(6,943 posts)Except that first-degree requires premeditation, doesn't it?
Aristus
(72,121 posts)She pulled the trigger intentionally.
How is that not premeditated?

(20,047 posts)As this sits now it's too easy to feel she intended to terrify the little girl, if her death was intentional or not. The terror she inflicted in the little girls last moments most definitely were.
I hope they have laws on the books to make sure this level of fatal child abuse assures she never sees the light of day again. Even if they can't make murder stick, she deserves to be in prison for the rest of her demented life.

(18,589 posts)Having said that, most people are taught early to NEVER point a gun at anyone, loaded or not.
Watch an experienced firearm handler... if they want to tear down a gun or clean it, whatever... they will remove the mag and rack the slide a couple times AND lock the slide BACK and visually verify no bullet in the gun.
