Weird, really. Nearly every case requests a jury trial because you have a chance with a jury. This type of case in front of only a judge? Not a good chance. That's what he gets for hiring inexperienced lawyers.

According to the legals on meidas touch, this phase is almost always handles as a bench trial in nys. It is true that his dime store lawyer didn't check the box for a jury trial for the main event though. But since it was a directed verdict, no trial was needed.

pre-trial motions are done. If they had checked the box, they'd be going through jury selection

James made a motion for a default judgement and the judge agreed on two of the most serious charges. He already ruled that that the defendents engaged in persistent fraud, and ordered that the trump org and all subsidiaries be dissolved and their assets be put into receivership.

The remaining charges are to determine damages and other issues. This portion would have come after the two charges already decided would have been presented to a jury, but would have been handled as a bench trial.

The default judgement eliminated the need for a trial to establish guilt, which is where a jury would have been used.

Since it's a civil trial they would pick 6 jurors and it would only require 5 to rule against him.

Maybe they thought the odds of 2 of 6 New Yorkers not hating him were just too risky for them to chance it?

She probably wasn't familiar with how New York State Civil Procedure goes. And I'll doubt "ineffective council" will be able to move the needle much. He failed to provide a coherent defense. Civil trial is about preponderance of any evidence, so the burden is on the defendant to rebut the plaintiff's claims. He and his team failed to make any substantive claims so he got hit with a default judgment this is now only about assessing damages.

in front of the bench or get a plea bargain, generally, people can request an information of fact about the charge. An officer will to take a reduced plea will sometimes tell the person not to request the information and come to court.
