Boebert facing defamation lawsuit

GRAND JUNCTION, Colo. (KREX) — Federal Judge Kathryn A. Starnella denied Lauren Boebert’s initial attempt to avoid discovery in a defamation lawsuit filed against her by David B. Wheeler. Wheeler, head of the American Muckrakers, filed a lawsuit in June, saying Boebert had badmouthed him on national TV. Wheeler and the Muckrakers accused Boebert of having two abortions, smoking illegal drugs, and working as an escort on sugardaddymeet.com.

Boebert wanted the case dismissed, claiming she had the right to defend herself against the allegations. If the case goes to a discovery, muckrakers will have the option to subpoena her for documents, emails, and texts ...

9. Muckraker's defense here is the old 'people are saying'

(including on 'social media') - and that make Boebert's charge that he/they are knowingly pushing lies - defamatory. The action committee's position is that while they don't know the allegations to be true, they don't know them to be false either. And ironically, while the defamation may well run in both directions here - Boebert as a 'public figure' has much less protection against it than would a private citizen (or a PAC such as Muckraker?).

In an interview, Wheeler acknowledged that they weren’t saying they had conclusive proof Boebert did what she was accused of, but that the allegations were corroborated by multiple sources and widely spread on social media. He notes that when one accusation was explicitly disproven, he took it down from his website.

Boebert is completely unfit for the office, and I'm going to be as happy as anyone to see her gone - hopefully with a resounding defeat and the voter's boot up her a**. Same time - not real sure that I can be terribly happy with Muckrakers rather casual relationship with 'truth' and facts. Is it safe to say a pox on both their heads?

to being okay with misinformation and a disregard for truth - even when the target for those tactics is total slime and completely deserving of all manor of ugly karma. Others apparently see it as fair play ... But, just not the way I roll ...

Humor and memes are one thing. These things are understood for what they are. (well, mostly - we do have those that are 'challenged') Publishing and perpetuating false and misleading ... IMO - that is something else. Not for fun. Its aim is to mislead and misinform. You may disagree. But I believe it is a disservice.

14. ... The Western Slope congresswoman did get a temporary restraining order issued against Wheeler

on June 23, but a judge vacated the order this week and dismissed the case. Wheeler’s attorney was present for the court proceeding about extending the order, but no one came to represent Boebert, according to Wheeler.

Meanwhile, the PAC has filed a complaint against Boebert with the House Office of Congressional Ethics.
