(131,217 posts)wouldn't it make more sense for TFG to invoke the privilege and claim she was acting as his attorney and that he was relying on her advice? But he doesn't think strategically, just reactively - so whenever someone associated with him gets in trouble he just reflexively distances himself from them.

He is playing to the public, not the courts with this argument. It means nothing to his charges whether she changed his diapers or filed his briefs.

(60,320 posts)Just being in a conversation in the Oval Office is more akin to an Adviser than a personal attorney. Even if the person is a lawyer, it is not automatically client-attorney conversation.
Asking to be appointed Special Counsel is not the same as being a personal attorney.
Being appointed Special Counsel (good thing she never was) is the nothing like being a personal attorney, though there is little doubt that she would have slavishly worked against his personal targets.
The Oval Office conversation is not evidence that tRump's claim is demented.
There is lots of other evidence of his decline. Confusion over World Wars, airports in the Revolutionary War, mixing people up, repeating himself, devolving into word salad as he gets more confused about some point he thinks he is making.

(60,320 posts)Lawyers are not always working in lawyer mode. Sometimes they work in other modes. "Hey, we should print t-shirts that say Stop the Steal and others that say Civil War 2 Has Begun", "I can go on a show and talk about Releasing the Kraken!"
Like a submarine commander might work as a carpenter for Habitat for Humanity.
She was working for tRump, but not as a lawyer. The reason is that there are some protocols around when lawyers are actually working as official counsel and those protocols are a little more complicated for government officials. I'm sure she was not officially his lawyer.
That all said, she undoubtedly make comments and suggestions on legal aspects of the insurrection, but not officially as his lawyer.
There are technicalities and then there is reality, of course.
But in the end, it doesn't matter, NOW, since tRump voluntarily took away his own "acting on advice of attorneys" defence with regard to Powell. So she can't be bound by attorney-client privilege in the Georgia case, even if it could be asserted (can't be because advice in process of committing crime or aiding and abetting crime is not protected). This probably also frees Jack Smith to use her testimony and record of testimony wherever he likes.

More importantly today is how much dirt does she have on Trump because she has now crossed the River Jordan and has promised to sin no more. She is fighting to save her ass, which is always good motivation. That bump you just felt was the bus rolling over Trumpty Dumpty.
Today Trump feels it is best if she wasn't his lawyer, if that changes, he will swear that she has always been his lawyer and he has never said anyting to the contrary. Trump's base will follow him through every twist and turn. George Orwell described this kind of behavior.

(54,330 posts)GOP politicians are afraid of the cult, so they'll continue to pretend the orange wannabe king isn't a babbling idiot. He'll be their nominee, guaranteed. As for Biden vs. Trump. They'll try their hardest to make Joe seem like the babbling idiot Trump is and they might have some success given people rarely take their noses out of their phones. Democrats just have to push the accomplishments constantly and - most importantly, IMO - abortion rights. I think 2024 will be won or lost on abortion rights.
