The best a third party would do is cause the election to be decided by the House, and

with a repuke majority, Trump would get the WH. The only way to avoid that is gain enough electoral college votes so it isn’t tied

It said that the new House is sworn in in early January and the president would be chosen after that date. But you may be correct, I’ll go to google and check it out.

On edit: in the article you linked, it says the members elected in November of 24 and seated in Jan 25 would select the president.

It’s looking like Stein, Manchin, and Kennedy will be on the ballot along with Biden and Trump, of course. I pray that people aren’t stupid enough to vote for any of the third party candidates (or Trump for that matter).

It is never the prior congress in any matter related to the upcoming term. That's why the house and senate are certified and seated before the inauguration.

But…your point that just winning the house is still valid since it’s a one state one vote system. More states delegations will likely be R than D even if more reps are D.

Going to the house will be a disaster.

And that vote gets cast by the majority vote of the members from that state. And the Repukes have a majority in a majority of the states. So the Repuke candidate would get elected by the House, if it came to that. Let's hope it doesn't!
