According to former Solicitor General Neal Katyal, Donald Trump's loss on Friday in an appeals court ruling on his presidential immunity defense claim was bad for the former president but what made it worse was who signed off on blowing it out of the water.
Appearing on MSNBC with host Jonathan Capehart, the legal analyst joked that the assertions by Trump lawyers that the president could commit illegal acts with impunity was so ridiculous a "fourth grader" could see through it, before pointing out that an appointee on the appeals court panel that ruled against him used to be one of Trump's top White House lawyers. That, he noted, does not bode well for the future of the embattled ex-president as even more lawsuits loom.
Speaking with host Capehart, Katyal smirked and explained, "I think the average fourth grader can tell you attempting to overturn a lawful election doesn't exactly fall within the job description of the president. This appeals court yesterday made that important distinction official," he added. "And, Jonathan, notably, on that appeals court was a judge, Judge [Gregory] Katsas," he pointed out, "who is not just a Trump appointee, he was Trump's deputy White House counsel, you know."
"So [he was] the number two lawyer at the White House and Katsas ruled against Donald Trump," he continued. "So, that tells you all you need to know. Trump can try to spin this as a bunch of Obama judges, but no, these are Trump judges."

(22,967 posts)Trump's strategy isn't to win these appeals, that would be a huge cherry on top, Trump's strategy is to delay all trials past the election.
Get back with me Neal when the Supreme Court takes its ever lovin' time to rule that Trump is not a king.

(1,718 posts)Just cause someone is a supreme court judge doesnt mean they are any fucking good, just like any field of endeavor. Yes some are decent very competent balanced judges who try to do the right thing ( usually democrats). Some are not, like the ideological crazies we are all familiar with. As recent examples, just look at some of the many federal judges the deplorable Orange Menace appointed along with the help of the weak and crazy MAGA nut jobs in congress.
Course if the voters are insane enough to re-elect our favorite would be modern day Hitler, who has already said he will declare the insurrection act in place on day one, the rule of law will be tossed out the window. Hopefully we have more sensible voters than numbskulls.

(17,679 posts)The courts have been deciding against him mostly. (except for one in Florida ofcourse. She is the STALLER) Deciding against him, BUT taking their sweet time between decisions! Every delay is a WIN for this bastard! I cannot wait for his FINAL court decision!!

(10,371 posts)And unless someone's taken his passport, even if he's been convicted, he won't be sentenced till after the inauguration. If he loses, he will flee the country...he'd be an absolute idiot to put himself within a hundred miles of a sentencing courtroom.

(37,918 posts)That we applaud a judge for doing the right thing. Instead of being thankful for the proper ruling we are elated at the audacity that the judge didnt rule in favor of the treasonous bastard, serial lying morally degenerate, convicted sex offender.
