How the hell can AG TX Ken Paxton start jailing people in another state Washington for not complying with his order?

This is bullshit to me. Fuck this guy!

https://www.erininthemorning.com/p/texas-ag-threatens-seattle-hospital

Attorney General Ken Paxton has sent a civil investigative demand to Seattle Children's Hospital, demanding data on all Texas patients traveling for care, despite having no jurisdiction there.

According to a complaint filed by Seattle Children’s Hospital in Travis County on December 7, the office of the attorney general under AG Ken Paxton has demanded that the hospital turn over patient data for transgender patients who traveled or moved from Texas. The demands include “no redaction” and apply to any Texas trans youth. The letter also states that the hospital is required by law to “wean children off of” gender-affirming care if they travel or have moved from Texas. The letter lists several other records-related demands and even threatens Seattle hospital workers with jail time if they do not comply.

Seattle responded to the request by filing a lawsuit in Travis County, stating they cannot comply because Texas has no jurisdiction in Washington State, and no care was provided by the hospital in Texas. They also point out that the Dormant Commerce Clause, protected by the United States Constitution, “protects the right to interstate travel, including to obtain healthcare services.” By targeting out-of-state hospitals for enforcement of laws that only apply within the jurisdiction of Texas, they “discriminate against healthcare based on an interstate element,” violating constitutional protections, according to the legal filing. Lastly, Seattle Children’s Hospital cannot comply due to a shield law passed by Washington State. This law bars the hospital from providing any patient data and from responding to subpoenas pursuant to “protected healthcare services” obtained within the jurisdiction of Washington. Protected healthcare services include abortion, reproductive care, and gender-affirming care.

Ken Paxton and aides ordered to answer questions under oath in whistleblower case

The four whistleblowers asked the court last month to force the attorney general and his aides to sit for deposition, which would require them to answer questions under oath related to the allegations of bribery and corruption.

BY PATRICK SVITEK
DEC. 20, 2023
UPDATED: 23 HOURS AGO

Travis County district judge has ordered Attorney General Ken Paxton and three top aides to sit for depositions in the 3-year-old whistleblower lawsuit against him.

At a hearing Wednesday in Austin, Judge Jan Soifer granted the whistleblowers’ motion to compel the depositions of Paxton; Brent Webster, the first assistant attorney general; Lesley French Henneke, chief of staff at the agency; and Michelle Smith, Paxton’s longtime political aide.

Paxton himself was coincidentally served earlier in the day at a restaurant in Austin, according to a whistleblower lawyer, Tom Nesbitt.

“In this case, I believe the plaintiffs have shown good cause that these four people have unique and superior knowledge of discoverable information,” Soifer said from the bench, adding that the four people were “not just figureheads” but people who knew about issues “at the heart” of the case.

Fri Dec 22, 2023, 04:05 PM
Dec 2023

60% to 100% of Texas health and human services are federally funded.

The point is that Texas wants to operate with no federal restraints and doesn't want to follow federal law.
But still has its hand out for federal monies. They are happy to feed at the federal public trough.

https://everytexan.org/our-work/policy-areas/budget-taxes/federal-budget-taxes/#:~:text=Federal%20expenditures%20in%20Texas%20are,tenth%20of%20preK%2D12%20investments.

Federal expenditures in Texas are one and a half times as much as what our state and local government revenues pay for, combined. Federal dollars account for one-third of the Texas state budget and one-tenth of preK-12 investments.
Federal aid is especially critical in state health and human services (almost 60 percent federally funded overall) and nutrition benefits (almost 100 percent federally funded).

Outside the state budget, Social Security and Medicare provide near-universal income support and access to health care for Texas seniors, while federal tax credits such as the Earned Income Tax Credit and Child Tax Credit are powerful anti-poverty tools.

PS Insinuating people are liars is a sign of a weak argument.

This is what they want.

Depending on what part of the country you’re in, it’s possible you’ve seen related headlines locally. The Courier Journal in Kentucky, for example, also reported yesterday that Republican state Attorney General Daniel Cameron also wants his state to be able to access private out-of-state medical records.

The Arkansas Times reported that Republican state Attorney General Tim Griffin wants the same thing. So does Republican state Attorney General Chris Carr of Georgia as well as Republican Attorney General Lynn Fitch of Mississippi. In fact, as Rachel noted on last night’s show, it was Mississippi Today that broke this story in the first place.

All told, a total of 19 state attorneys general have signed on to a joint letter to the U.S. Department of Health and Human Services, making the case for being able to access out-of-state medical records — not just for abortion, but also for gender-affirming care.

35. I have a few questions for Paxton
Thu Dec 21, 2023, 09:02 PM
Dec 2023

I live near Las Vegas. I just looked it up and there are several flights per day, non-stop, from various airports on various carriers in the state of texass (my preferred spelling) to Las Vegas.

Also, the only casinos in texass are on sovereign tribal lands, subject to their own laws. The state does not allow gambling and casinos.

Therefore, thousands of people a day leave tx and travel to Nevada to do something that is illegal in their own state. There are also areas here where prostitution is legal. Is there a chance that good, honest, Christian texan men are partaking in other activities that are illegal at home as well?

Here's the big question: how many of those travelers are subject to arrest when they return home from Sin City? How many casinos has Puckston contacted to find out who is using texan ID to check in to hotels and gamble?

Hhmmm...? What's that you say, lil Kenny? It's not the same thing? Why not? Your own citizens are leaving your state to go to another state and engage in activities outlawed at home. Better go after them, too - but good luck getting any kind of information from Nevadans. We take the ol' "what happens in Vegas stays in Vegas" very seriously around here.

However, to enforce one, the target must have some jurisdictional link to the issuing state -- for example, doing business in the state. Thus, for example, a state wanting to issue a CID to Twitter, would be able to do so because Twitter has a jurisdictional nexus to the state.

The hospital in Washington is arguing, among other things, that it has no jurisdictional link to Texas.

Supreme Court Rejects Texas Suit Seeking to Subvert Election

The suit, filed directly in the Supreme Court, sought to bar Georgia, Michigan, Pennsylvania and Wisconsin from casting their electoral votes for Joseph R. Biden Jr.

By Adam Liptak
Published Dec. 11, 2020Updated Jan. 15, 2021

WASHINGTON — The Supreme Court on Friday rejected a lawsuit by Texas that had asked the court to throw out the election results in four battleground states that President Trump lost in November, ending any prospect that a brazen attempt to use the courts to reverse his defeat at the polls would succeed. The court, in a brief unsigned order, said Texas lacked standing to pursue the case, saying it “has not demonstrated a judicially cognizable interest in the manner in which another state conducts its elections.”

The order, coupled with another one on Tuesday turning away a similar request from Pennsylvania Republicans, signaled that a conservative court with three justices appointed by Mr. Trump refused to be drawn into the extraordinary effort by the president and many prominent members of his party to deny his Democratic opponent, former Vice President Joseph R. Biden Jr., his victory.

It was the latest and most significant setback for Mr. Trump in a litigation campaign that was rejected by courts at every turn. Texas’ lawsuit, filed directly in the Supreme Court, challenged election procedures in four states: Georgia, Michigan, Pennsylvania and Wisconsin. It asked the court to bar those states from casting their electoral votes for Mr. Biden and to shift the selection of electors to the states’ legislatures. That would have required the justices to throw out millions of votes.

Mr. Trump has said he expected to prevail in the Supreme Court, after rushing the confirmation of Justice Amy Coney Barrett in October in part in the hope that she would vote in Mr. Trump’s favor in election disputes.

Pennsylvania AG Decries Texas’ Bonkers Election Lawsuit As ‘Seditious Abuse’

By Summer Concepcion | December 10, 2020 5:41 p.m.

Pennsylvania Attorney General Josh Shapiro on Wednesday decried Texas Attorney General Ken Paxton’s lawsuit boosting President Trump’s long-shot attempts at overturning election results as “seditious” and built on an “absurd” foundation.

In a 43-page brief signed by Shapiro and six of his deputies, the battleground state’s attorney general argued that Paxton is bringing “only discredited allegations and conspiracy theories” in waging his last-ditch effort at Trump winning a second term.

“The Court should not abide this seditious abuse of the judicial process, and should send a clear and unmistakable signal that such abuse must never be replicated,” Shapiro said. “In support of such a request, Texas brings to the Court only discredited allegations and conspiracy theories that have no basis in fact.” Shapiro added that “accepting Texas’s view would do violence to the Constitution and the Framers’ vision.”

(snip)

Rep. Mike Johnson (R-LA) spearheaded the effort to strong-arm his House GOP colleagues into signing the brief. “This brief presents [our] concern as Members of Congress, shared by untold millions of their constituents, that the unconstitutional irregularities involved in the 2020 presidential election cast doubt upon its outcome and the integrity of the American system of elections,” the amicus brief signed by 106 GOP lawmakers said.

... what I can add that hasn't already been said in this thread. Texas has definitely defended its claim to the dubious distinction of ANUS of the UNIVERSE. But keep trying, Florida; you're a close second.
Paxton is a textbook psychopath, just like Abbott and Patrick, and as long as there are enough Texans that repeatedly vote for those evil wastes of skin, the Terrible Trio will continue to push the envelope to see how much they can get away with.
When Biden crushes the Gangrenous Boil on the Ass of Humanity – if he even gets to run – he should also reduce those three to grease spots on the floor.

it is about control.

He gets to terrify parents of trans kid and others who need to leave the state to get appropriate medical care. Some will leave the state for good, which he, no doubt sees as a good thing.

He also gets to performatively "seek justice" against the people the Republican base hates. Doesn't matter if it is legal or not, it makes him look like the giant asshole they adore.
