Attorney General Ken Paxton has sent a civil investigative demand to Seattle Children's Hospital, demanding data on all Texas patients traveling for care, despite having no jurisdiction there.
According to a complaint filed by Seattle Childrens Hospital in Travis County on December 7, the office of the attorney general under AG Ken Paxton has demanded that the hospital turn over patient data for transgender patients who traveled or moved from Texas. The demands include no redaction and apply to any Texas trans youth. The letter also states that the hospital is required by law to wean children off of gender-affirming care if they travel or have moved from Texas. The letter lists several other records-related demands and even threatens Seattle hospital workers with jail time if they do not comply.
Seattle responded to the request by filing a lawsuit in Travis County, stating they cannot comply because Texas has no jurisdiction in Washington State, and no care was provided by the hospital in Texas. They also point out that the Dormant Commerce Clause, protected by the United States Constitution, protects the right to interstate travel, including to obtain healthcare services. By targeting out-of-state hospitals for enforcement of laws that only apply within the jurisdiction of Texas, they discriminate against healthcare based on an interstate element, violating constitutional protections, according to the legal filing. Lastly, Seattle Childrens Hospital cannot comply due to a shield law passed by Washington State. This law bars the hospital from providing any patient data and from responding to subpoenas pursuant to protected healthcare services obtained within the jurisdiction of Washington. Protected healthcare services include abortion, reproductive care, and gender-affirming care.

This is similar to why Cheney wouldnt go to Europe. Several countries had filed complaints against him for Iraq war crimes, and technically he could have been arrested and taken to the ICC.

In 2012, a private tribunal in Malaysia found Dick Cheney and other members of the Bush administration guilty of war crimes. This was a symbolic ruling and had no legal effect.

Travis County district judge has ordered Attorney General Ken Paxton and three top aides to sit for depositions in the 3-year-old whistleblower lawsuit against him.
At a hearing Wednesday in Austin, Judge Jan Soifer granted the whistleblowers motion to compel the depositions of Paxton; Brent Webster, the first assistant attorney general; Lesley French Henneke, chief of staff at the agency; and Michelle Smith, Paxtons longtime political aide.
Paxton himself was coincidentally served earlier in the day at a restaurant in Austin, according to a whistleblower lawyer, Tom Nesbitt.
In this case, I believe the plaintiffs have shown good cause that these four people have unique and superior knowledge of discoverable information, Soifer said from the bench, adding that the four people were not just figureheads but people who knew about issues at the heart of the case.

The point is that Texas wants to operate with no federal restraints and doesn't want to follow federal law.
But still has its hand out for federal monies. They are happy to feed at the federal public trough.

The Arkansas Times reported that Republican state Attorney General Tim Griffin wants the same thing. So does Republican state Attorney General Chris Carr of Georgia as well as Republican Attorney General Lynn Fitch of Mississippi. In fact, as Rachel noted on last nights show, it was Mississippi Today that broke this story in the first place.
All told, a total of 19 state attorneys general have signed on to a joint letter to the U.S. Department of Health and Human Services, making the case for being able to access out-of-state medical records not just for abortion, but also for gender-affirming care.

He also knows damn well, as do the other RW AG's in red states, that they cannot do squat to stop a state resident from having ANY procedure out-of-state. While it is possible some could be charged upon their return, the goal is to goad them into submission to not leave the state(s).
Man, after all these years, I do hope he's found guilty and is jailed. Ah, but he has Abbott, the TX SC and millions of rabid MAGATS behind him. No odds here on any conviction, sadly as hey, it is TEXASS!

(7,864 posts)I live near Las Vegas. I just looked it up and there are several flights per day, non-stop, from various airports on various carriers in the state of texass (my preferred spelling) to Las Vegas.
Also, the only casinos in texass are on sovereign tribal lands, subject to their own laws. The state does not allow gambling and casinos.
Therefore, thousands of people a day leave tx and travel to Nevada to do something that is illegal in their own state. There are also areas here where prostitution is legal. Is there a chance that good, honest, Christian texan men are partaking in other activities that are illegal at home as well?
Here's the big question: how many of those travelers are subject to arrest when they return home from Sin City? How many casinos has Puckston contacted to find out who is using texan ID to check in to hotels and gamble?
Hhmmm...? What's that you say, lil Kenny? It's not the same thing? Why not? Your own citizens are leaving your state to go to another state and engage in activities outlawed at home. Better go after them, too - but good luck getting any kind of information from Nevadans. We take the ol' "what happens in Vegas stays in Vegas" very seriously around here.

Paxton is a textbook psychopath, just like Abbott and Patrick, and as long as there are enough Texans that repeatedly vote for those evil wastes of skin, the Terrible Trio will continue to push the envelope to see how much they can get away with.
When Biden crushes the Gangrenous Boil on the Ass of Humanity if he even gets to run he should also reduce those three to grease spots on the floor.
