Is an appeal to the circuit court, before seeking cert from the SCt.

Choosing not to hear an appeal when it is not yet ripe hardly constitutes enabling efforts at delay.

Smith will now have to wait on the D.C. Circuit to act on Trump's immunity appeal

and yes..delay..hopefully the DC Appeals court..by then (January) they will have enough evidence to expedite..

The issue was that once they do rule, then THAT decision will inevitably be appealed, all the way through the normal judicial process, until it hits the Supreme Court, which is why Smith was saying let's get this over with and you all go ahead and make your decision now.

their ruling the pos DOES NOT HAVE Presidential Immunity..appeal away pos..here is where the rubber meets the road SCOTUS..are they really going to let him off scott free..

Might be better for Appeals Court to hear it first.

We got a good draw on judges.

IMHO, the more case law the SC has to work with, in this instance anyway, the better.
