(7,309 posts)The right argues that he hasn't been criminally convicted of insurrection and therefore he is not precluded from being on the ballot. Well, after the civil war, some southern Senators tried to run for president, but were not allowed on the balot due to their participation in the confederacy. Not convicted of any crime, but participated in insurrection. And it was upheld.
So there is that precedence.
