Jan. 6 participant Ashli Babbitt's husband, conservative group file a wrongful death suit against U.S. governmentJudicial Watch attorneys filed the complaint in federal court in California, on behalf of Babbitt's estate and husband, Aaron Babbitt, for wrongful death and assault and battery. The suit claims U.S. Capitol Police Lt. Michael Byrd was negligent when he fired a single fatal shot that struck Babbitt, a supporter of Donald Trump who joined a mob that broke into the Capitol trying to halt the certification of his electoral loss, in the shoulder as she climbed through a door leading to the House chamber. Lawmakers were being evacuated from the House floor.
"The facts speak truth. Ashli was ambushed when she was shot by Lt. Byrd," they wrote.
The lawsuit alleges that Babbitt, an Air Force veteran who was a decorated security forces controller, had traveled to Washington from her home in San Diego, Calif., to attend the Save America rally on Jan. 6, where Trump delivered a speech outside the White House.
"Ashli did not go to Washington as part of a group or for any unlawful or nefarious purpose," they wrote, adding that Babbitt was unarmed and "posed no threat to the safety of anyone."

More likely, the lawsuit will be dismissed and the government can seek its costs and possibly attorneys fees.

(5,119 posts)She was the first, and the last, person who tried to get through the opening created by the broken-out glass pane. The officer and others inside the closed room were in danger of being killed by the mob. The officer fired in self-defense as Mrs. Babbitt was making her way through the opening. In my opinion, there are no grounds for a wrongful death lawsuit.

She participated in an uprising to overthrow the government and overturn a free and fair election. That's a fucking crime. Get over yourselves, losers.

Think of the video of the incident. The group of rioters pushing up against the doors were sandwiched by a group of SWAT officers from behind and the door to their front.
Within seconds after the shooting, they were surrounded by officers.
They weren't going anywhere... a foolish bunch of jackasses costing a woman her life.

She was stopped from doing this by a law enforcement agent with deadly force, which was necessary considering the situation that hundreds or thousands of dangerous insurrectionists were going to follow her into the legislative chambers.

It's too bad she's dead, but if she didn't go into the Capitol with that mob she'd be alive today.
Her shooting stopped that mob cold. Who knows what would have happened if they gained access to that room.
