Jack Smith is revealing how deep he is into the cellphone/cloud accounts of Trump and his co-conspirators in the classified documents case. One FBI agent found photos of classified documents were texted from Walt Nauta's devices to another Trump employee.

It’s definitely a conflict, but not sure it’s illegal if trump resorts charged fair market rates. But it darn sure doesn’t look good.

Now, if he got fees for espionage, influence, and the like, that’s clearly illegal.

business ventures. The fact that he was so reluctant to turn over classified docs. makes me believe there was a financial motive.

As I understand it, he may have violated the Foreign Emoluments Clause, regardless.

With the documents 'thing' something quite, quite clearly different than patronage of Trump's hotels, golf courses, etc.
And - my impression - the speculation about 'Emoluments clause' is also pretty iffy.

to say that’s emolument, assuming fair value. If it’s different from “rent, that might be a different matter. It’s definitely questionable and one of many reasons I despise the POS.

so there's no question of improprieties putting the wishes of a foreign or domestic client above that of the nation.

It's ridiculous that there is any question as to the inappropriateness of this.

“Emoluments Clause”:
 The Foreign Emoluments Clause (art. I, § 9, cl. 8):
“[N]o Person holding any Office of Profit or Trust under
[the United States], shall, without the Consent of the
Congress, accept of any present, Emolument, Office, or
Title, of any kind whatever, from any King, Prince, or
foreign State.”


That's been interpreted to mean that presidents can't make money from foreign governments. There's this longstanding rule (of course, broken by Trump) that any gift worth more than $25 (?), even ceremonial, from a foreign government, must be turned over to the GSA or some agency.

And at least when he was president, there was a lot of talk that these governments were deliberately renting rooms from his hotel (which was leased from the government, btw-- the old post office) in order to curry favor.

And remember when he wanted to hold some international conference-- the G7? maybe-- at his Doral golf course-- in JUNE, when because of heat and humidity, there would ordinarily be few guests in a Florida resort.

Grrr... and at least 45% of the populace want to go back to that corruption.

For sake of discussion , this is about the classified document case. The former president is appropriately charged in Florida on this. One can question the objectivity -- if it exists -- of the judge in the case. The fact that the defendant's butler had photographs of sensitive documents on his phone is evidence of both the careless nature of the defendant in storing the documents, and his willingness to share them with others who had no right to see them.

More, Nautu is facing eight serious charges that could result in a 90-year prison sentence. My understanding is that Judge Cannon decided his trial will follow the defendant's.

It is possible -- perhaps likely -- that Nautu's legal team will work out a plea deal that includes his testifying against his master in return for a reduced sentence. His "regular" attorney, Stan Woodward, is no fool. I'm not familiar with the Florida one, Sasha Danad, a former public defender.

In the other federal case, I would like to have seen more people -- Bannon and Stone, etc -- charged. However, I understand that the DOJ has to be confident they have a 95% chance of conviction, before they indict. I assume that is why these scums haven't been charged.

What will stop MSM from telling lies to boost Trump and harm POTUS Biden?

There were 6 charges leveled against Nauta including obstruction, lying to the FBI, and finally 3 dealing with "concealing a document or record" (2 of which were related to national defense). And those latter charges might be what the OP texts of docs could be associated with.

Seems more likely that we were photos of the CLASSIFIED folders, not the documents inside. IOW supporting evidence that Classified materials were there and not “planted”
