Shawn Crowley, an attorney for E. Jean Carroll, urged a jury to fine Donald Trump enough money so that he would never defame her client again. During opening remarks in Trump's second defamation trial brought by E. Jean Carroll, Crowley explained how Trump sexually assaulted the writer in 1996. As then-president, Trump denied the claim. He was later found to have defamed Carroll.
"He was President, he used the world's biggest microphone against Ms. Carroll. He told lies. That's already been decided," Crowley said, according to a transcript provided by Matthew Russell Lee of Inner City Press. Trump's goal was "to humiliate her and to destroy her reputation," she added, according to Politico reporter Erica Orden. "Everything he said was a lie."
Crowley noted that Trump has continued to post about Carroll on social media including during the trial which started Tuesday. "How much money will it take to make him stop?" Crowley asked. "Because he has not stopped."
"He sat in this courthouse you saw him [and] while he was sitting here, he posted more defamatory statements," she added. "More lies about Ms. Carroll & this case. By our last [count], 22 posts just today. Think about that when you consider how much money it will take to get him to stop."

Rule 48. Number of Jurors; Verdict; Polling

(a) Number of Jurors. A jury must begin with at least 6 and no more than 12 members, and each juror must participate in the verdict unless excused under Rule 47(c).
(b) Verdict. Unless the parties stipulate otherwise, the verdict must be unanimous and must be returned by a jury of at least 6 members.
(c) Polling. After a verdict is returned but before the jury is discharged, the court must on a party's request, or may on its own, poll the jurors individually. If the poll reveals a lack of unanimity or lack of assent by the number of jurors that the parties stipulated to, the court may direct the jury to deliberate further or may order a new trial.

(10,908 posts)Both the preponderance of the evidence standard and the clear and convincing evidence standard are not as high a standard as proof beyond a reasonable doubt, which is used in criminal cases. Clear and convincing evidence is higher than preponderance of the evidence, which means more likely than not. Clear and convincing evidence leaves no substantial doubt in the jurors mind and establishes that the proposition is highly probable.
The jury had to be unanimous to reach a verdict but could have reached a different verdict on each of the two claims battery and defamation.

(4,741 posts)Civil cases don't require a unanimous jury verdict, only a majority. In NYS, it's 5/6ths of the jury. If 12 are on this case, then it means it takes 10 for a decision.
Since it's New York, I doubt 3 of those jurors will side with the Tangerine Titty Baby.

If Donald Trump were a petty criminal - instead of the very high-level career criminal he really is - he'd be the kind of guy who got sentenced to 10 years in jail for robbing gas stations then when the judge gave him two weeks to get his affairs in order he'd spend those two weeks robbing more gas stations. Nothing, outside of putting him in prison, is going to stop the crap he is doing. Trump isn't wired for pro-social behavior.

(688 posts)He doesn't care about how much is in his bank accounts since he lives off the money he can borrow, steal or beg his followers for. It's just something that he uses to keep going and he knows he can always get more. His whole life has shown him that there is always a sucker that will pay for whatever he wants. This trial is the same, he will use it to raise money to pay more lawyers to drag on the appeals forever and he will never pay her a dime. He is a master at manipulating the system and it's depressing. That's why the only good punishment for him is jail or a complete abandonment of all of his followers. Unfortunately the later will never happen.

(4,741 posts)They don't have enough assets to keep paying his legal bills and his fines and his settlements and his lost lawsuits, too. Not forever. The people upchucking money to him don't have limitless means. Eventually, they'll either have to make hard choices between food on the table or paying him...or they'll die off. Or get tired of giving so much and getting so little in return.
Losing in 2024 will cut the stream off significantly. That would probably be the straw that breaks them. One stolen election, yeah, they could believe that. But two starts reeking of crying wolf.
