update on the 81 yr old man tossed down escalator in Texas. There is more to the story

he opened door to a dressing cubicle and it was slammed shut because it was occupied.
he was told "this is a woman's dressing room".
He replied, "no, it's a handicapped dressing room"

The woman in that changing room is believed to be the girlfriend of the man who pulled the fellow shopper down the escalator.

This, officers say, is what likely led to the attack seen on videos across social media shared by the San Antonio Police Department earlier this week. However, Franklin says he wants to speak with the woman in the changing room and her boyfriend to confirm whether or not any nefarious behavior on the elderly man’s behalf occurred. Franklin told MySA there is surveillance footage at the mall confirming both the elderly man and the woman entered the changing room areas, but evidence was lacking to confirm the two parties were in the area at the same time.

Because no matter what happened in the dressing room, the old man was attacked from behind while on an escalator. No case for self-defense or companion-defense considering. Beyond that, if you're in a dressing room you should lock the door so that somebody doesn't accidentally walk in.

This being Dillards, there probably is, but I have seen places which have dressing rooms with just a curtain.

Young bully assaults elderly man. Charge one. Woman fails to go to his aid. Depraved indifference. Charge two. If the old man was guilty of a crime, notify store security and call the police. Taking 'justice' in his own hands ought get the burly thug jail time. BTW - If I was the old man I'd get a good lawyer and sue the shit out of the couple who did this.
