https://lawandcrime.com/high-profile/appeals-court-opens-floodgates-to-civil-liability-lawsuits-against-trump-for-jan-6/The floodgates exposing Donald Trump to civil lawsuits seeking to hold him accountable for the violent and destructive events at the U.S. Capitol on Jan. 6 are now open, according to an order from the U.S. Court of Appeals for the District of Columbia.
On Friday, the appeals court gave the green light to three civil complaints against Trump tied to Jan. 6. As Law&Crime previously reported, Trump missed his deadline at the Supreme Court to fight the civil lawsuits in February.
According to a 2-page per curiam order:
These appeals raise the same question that this court recently decided in Blassingame v. Trump. As a result, the merits of the parties positions are so clear as to warrant summary action. Blassingame held that former President Donald J. Trump lacks presidential immunity for actions that he took in his personal capacity as presidential candidate as opposed to in his official capacity as sitting President.
The three lawsuits approved to move forward on Friday are Marcos J. Moore v. Donald Trump; Bobby Tabron et al v. Donald Trump; and Briana Kirkland v. Donald Trump. All of the plaintiffs are police officers who responded to the Capitol on Jan. 6.

(196,539 posts)Yes, Trump promoted it and provoked them but the are adults. They decided to enter (many didnt) on their own. Their decision. It seems to me that blaming Trump is on par with saying this Ray Epps guy spurred every one of the on.

(8,103 posts)So, yeah, he promoted it. If you can't input that to those that injured COPS, then you can't ever prosecute anybody for inciting an insurrection, ever. Those guys being adults with free will doesn't excuse Trump. There are several Federal laws (sorry, can't remember the numbers) which explain this, and how culpable you are if you promote an insurrection. Trump should really be in jail, not running for a do over.

(12,670 posts)He not only instigated it and planned it with his MAGA idiots, he stopped others from sending in reinforcement for the cops that were attacked. He actively took part in stopping sending help.
Then he let it rage with barely lifting a finger to stop it. One stupid video was all he did then said good night, while people were still being tear gassed and chased out of the building.
During the attack, he sent a tweet encouraging the seditionists to go after Mike Pence. During the attack.

(3,363 posts)...would still be alive if not for TSF. It's because of his orders to his minions that they are not. I hold him completely responsible for their deaths, and for the severe injuries that were inflicted on many other officers that day. Between that and the epic way he mismanaged the pandemic, he is a MURDERER. He has blood on his hands and always will. He is a RAPIST and MURDERER. Biden/Harris and the DNC need to be all over this!!
