According to the legal talking heads on cable news, the defense will bring up the fact that the prosecution did not call to the witness stand Alan Weisselberg. This is to cast doubt on Michel Cohen's account of the meeting between Cohen, Weisselberg and Trump.
Here's my question. If the defense opens the door to this issue, can the prosecution in its closing argument refer to the NDA that the Trump organization has with Weisselberg prohibiting him from cooperating with any investigation and can the Prosecution also say that Weisselberg is currently in prison for lying to a court in favor of Trump?

Isn't it too late for that? Presumably if TFS gets convicted it could come up for review in appeals but

My guess the judge would cast it aside. IMO- Not an Attny.
