Claire McCaskill says the jurors will pick a foreman.

I thought it was reported the first person becomes foreman.

I did a search and it would be the first juror selected unless otherwise designated.

Personally I don't see why she should be on when she is not from New York.

It has been repeatedly reported and I'm a bit surprised Claire did not know that. But, that's the case.

The jury foreman is from Ireland originally but has been living in NYC most of his life.

Earlier today there was a first timer bringing up the OJ trial with the if the glove don't fit. Using shoe instead. And nobody said anything.

pretty silly.

I know they have 24 hours of programming to fill, but it’s a good reminder of why there really is no reason to watch cable news on a daily basis.

My recollection is that there were posts on DU about this subject, so it seems it was a matter of interest.

Unfortunately, few have and thus stumble into this... There is likewise an issue specific to NY law on instructing the jury that they can consider the "lesser included offenses-- of misdemeanors." That is ONLY true if the judge instructs the jury and AFTER the defense agrees to waive the two-year statute of limitations, which does not impact the felony charges. I have only heard one "legal talking head" describe that correctly.

Is from Missouri. She provides good commentary almost daily. Why not allow her to mis- speak on a minor point before bringing out the knives?
