(7,794 posts)The suffix of my comments were meant for the possible occasion of Trump's re-election. He will appeal, of course, and it will be argued that a state's jurisdiction should not have a "too great" bearing on a federal executive officer's disposition either campaigning or serving. In all circumstances, I wonder how the USSC will loom over the proceedings. I don't think they will be loathe to jump in, appropriately or not. The crazies of the House are surely preparing their lines for this not unexpected "next act".
The good judge will not, unfortunately, have the final word, no matter what it is. Such is the can of worms we have. He is probably more aware of this than anyone else in the world.

Yes this trial will move to its next stages, it is far from over.
All the appellate processes, Trump's hateful rhetoric, Congress, and yes the corrupt Supreme Court may bail him out.
I warn that Trump may pull some tricks we have not even thought of.
He is capable of that. And so are his minions.

(46,189 posts)Many convicted felons appeal their convictions, even if there is no jail time. And convicted felons who appeal their convictions almost never express remorse, not surprisingly.

So 5 years seems fair.

(18,348 posts)I suppose you dont have the privacy when you vote provisionally. When I worked elections right here in Tarrant County, voting provisionally you have to fill out a lot of paperwork identifying who you are. That would also allow the Election administration to review your ballot and who you voted for. Usually when it did occur, most of the time it was because you were not at the correct polling location. That has changed here for now. You can vote at any precinct as long as it is in Tarrant County.
The Tarrant County District Attorney's Office says they are appealing last month's ruling by a Texas appeals court that overturned a woman's 2018 conviction for illegal voting.
Crystal Mason was on probation for a felony conviction in 2016 when she voted in an election using a provisional ballot. She was convicted two years later of voter fraud and sentenced to five years behind bars because state law only allows felons to vote if they have fully finished their sentence, including any parole or supervision requirements.
Mason said she did not know that being on probation for a previous felony conviction left her ineligible to vote. Prosecutors maintained that she read and signed an affidavit accompanying her provisional ballot affirming that she had fully completed her sentence. Justice Wade Birdwell wrote in March 2024 that having read these words on the affidavit didn't prove Mason knowingly cast the provisional ballot illegally in 2016.
"Even if she had read them, they are not sufficient to prove beyond a reasonable doubt that she actually knew that being on supervised release after having served her entire federal sentence of incarceration made her ineligible to vote by casting a provisional ballot.
Birdwell then overturned Mason's conviction. On Thursday, the Tarrant County District Attorney's Office asked the Texas Court of Criminal Appeals to reverse Birdwell's ruling.

By only doing 3 months per charge the Judge can say he took Trump's age under consideration when making the decision.

(7,165 posts)Now I don't expect that to happen. They could ask for consecutive terms. That is unlikely. Each low level felony is 4 years max. I would be happy if he got to spend a year in prison then 3 years probation. Not having to hear his lies and garbage for a year would be pleasant.

(2,462 posts)We know trump is not capable of remorse. And given the way Trump has insulted and endangered the judge and his family it is hard to see why the judge should be merciful. Trump should go to jail. But I don't think it will happen.
When the election is over and Biden is re-elected Trump will definitely be going to jail. He will be shown no mercy.

(1,887 posts)It would be satisfying to see him jailed, but not sure if it would accomplish much. The important thing is to defeat him and then try him for January 6th and the documents and lock him up on more significant charges for that.

(527 posts)Cohen, too, was a first-time offender and went to jail for lying on behalf of convicted felon Trump. Now they found guilty the guy who directed him to do it. How would it not be justified to give convicted felon Trump jail as well?

(46,189 posts)Specifically, he plead guilty to five counts of willful tax evasion; one count of making false statements to a bank; one count of causing an unlawful campaign contribution; and one count of making an excessive campaign contribution. The maximum penalty for each violation was from five years to 30 years. His sentence was less the maximum for any of those eight counts.
His sentence for perjury was two months, to be served concurrently with his previous sentence.
