Sentencing and appeals are two different things. I am asking about an appeal. patricia92243 May 2024 #5
He is now a convicted felon. The appellate court would have to overturn it. Irish_Dem May 2024 #2
Thanks for the answer. If he won an appeal, would that make him NOT a felon. patricia92243 May 2024 #6
The appellate court can reverse a conviction, reduce a sentence, or release someone from prison. Irish_Dem May 2024 #9

Felon by a New York court of law and jury of 12. sentencing has no effect on his conviction.

The court allows for appeals if new evidence has come to light, legal rights were violated during the original conviction, or a judicial error happened.

So yes if they reverse a conviction, the person is no longer guilty, no longer a felon.

I am not an attorney so maybe someone else can chime in.
This is my understanding of the law.

So, the answer is it depends on who the "public" is.
I consider him a felon, and I think he wins an appeal strictly on a technicality.
Hence, 12 people thought he did it. I think he's a felon right now.
His cult, obviously, would disagree.

And he wasn't convicted by a jury.
I think the jury got blinded by smoke & mirrors, and the prosecution made a few big mistakes. Because of that a guilty man went free.
He did lose the wrongful death suit, so I don't think our opinion is far from accurate.

when the ‘convicted’ part becomes effective. It’s not stopping me from using it until then.

He will always be a convicted felon.

We should refer to him as what he is.
